• RTO India lost my dad’s car RC card

What should I do in my situation? We applied for address change on car’s RC on Feb 2021. We have been waiting for a long time for it to be done. We checked online, it seems that the change has been made successfully, and the card is dispatched on Sept 2021, but we never received it. We checked with RTO virar office, they say it has been dispatched, then we asked India Post and they say we haven’t received it. We can’t even apply for a duplicate card, cause the police refuses to give missing certificate.

File poluce complaint about loss of original RC card as it has not been received by you 

 

then apply for duplicate RC card on cases of police complaint filed by you

You take the consignment number and inquire in post. If they have sent it you will get it. Else apply for fresh or duplicate as it's not your fault. Rto needs to issue you afresh

You may ask the details of despatch from the RTO's Office under the RTI Act. Also, apply under the RTI Act to India Post to know the fate of the postal article, after getting the required details from the RTO. Then, you can plan further course of action.

There is procedure  laid down for everything. When the rta claims that something is dispatched, there is dispatch register in which  date of dispatch and number (outward) will be mentioned. On the dispatch number the postal receipt of posting will be affixed. Note the consignment number of postal receipt and check the transaction of consignment online of indiapost website where you will get everything as to date of booking and date of delivery if made. If the dispatch is not delivered it will be returned to sender. You can pinpoint where the dispatch is lost and take further action.

- If the said RC Card has already dispatch then there must be confirmation from the Post office 

- Further, as the Post office is refusing for the receiving of the same , then you can move an application before the post master of your area for giving an undertaking for non receipt of the card from the RTO. 

- Further, you can move an application before the RTO office after attaching the said undertaking of P.O. and thereby request to issue a new RC Card. 

- If refused , then file a compliant with the Transport Department.

If you do not want to stretch this issue legally and waste your time with the non cooperating officials, it would be better that you apply for duplicate copy of the RC duly certified by the authorities concerned

Take the consignment number of the postal parcel containing the RC card from RTO

Check on India Post website if any such consignment was even booked by the RTO for dispatching the RC card to your address 

If the parcel was indeed despatched then most likely its lost in transit 

So you will have to file a FIR with police 

And using that you then have to apply for a duplicate RC card to RTO
