• Can I lodge complaint of harassment from July 1991 and till 28 July 2021

 please refer to the above question
It relates to harassments by my relatives started in 1991 july,and it was continuing and last it was till 28 july 2021,when my patience broke and now i have decided to lodge complaint in police or in noida courts to seek justice.

In retrograde can police complaint or application to court be done to seek justice.

Harassment is continues offence like kidnapping or abduction. As long as harassment continues, offence continues, it can be from any past date. You can very much file criminal complaint for offence commenced in 1991 up to date.

Yes you may lodge a criminal complaint against the relatives as they are still harassing you. If they had stopped long back and you didn't do anything then you couldn't have lodged it now.

But as they are still continuing the harassment you have a legitimate cause.

If it is an continuing offence you can file complaint before local police station against the offenders 

 

if police don’t take action file private complaint before magistrate under section 156(3) of cr pc to direct police to investigate and submit report

- Yes you can file a complaint for the continuing offence before the local police 

- If no action from the police then you can send the said compliant to the higher police official 

- Further , if no response then you can lodge a compliant before the magistrate under section 156(3) CrPc for lodging an FIR and legal action.

At present there is no period of limitation for criminal prosecution and a court cannot throw out a complaint or a police report solely on the ground of delay although inordinate delay may be a ground for entertaining doubts about the truth of the prosecution story.
