• Where can i find a marriageability certificate under special marriage act?

I am trying to register my marriage in Cyprus. However, they are asking for a marriageability certificate under the special marriage act. When I checked I could only find this information for the state of Punjab. I need this from Kerala. How can I get this? I already have the single status certificate. This is a different one.

You have to fill marriageability certificate form 

 

2) enclose proof of date of birth , voter card or ration card 

 

3) you can visit Sevana website.and check whether they have said option

There is no such certificate available in India. 

You can though make an affidavit about your eligibility of marriage.

1. Marriage Ability certificate is commonly known as un-married certificate. It is compulsory when anybody intends to solemnize his marriage in any other country. This certificate commonly approves such a person is eligible for marriage.

DOCUMENT REQUIRED FOR MARRIAGE-ABILITY CERTIFICATE:-

 

  • Passport copy of the beneficiary
  • Adhaar card of the beneficiary (If available)
  • Abroad address of beneficiary (If living in abroad)
  • School Certificate/Birth Certificate of the beneficiary (If available)
  • Adhaar Card and mobile number of both parents
  • Attested affidavit of both parents
  • Attested affidavit of Sarpanch or Member Panchayat or M.C
  • Attested Affidavit of Numberdar

 

 

DETAILED PROCESS:-

First of all, you need to carry above-said documents and prepare your marriage-ability certificate file from any legal professional. Parents of the beneficiary are applicant for the purpose of the marriage-ability certificate. After that commonly 04 Affidavits are required for this certificate purpose which attested by Seva Kendra i.e. 01 affidavit of the father, 01 affidavit of a mother, 01 affidavits from Sarpanch or Member Panchayat or M.C or Numberdar (Any Two). Then you need to submit this file at nearest Seva Kendra. Then a letter of a publication issued by competent authority to an applicant for the publication in two selected newspapers or competent authority demand to deposit money for publication purpose. After the completion of all legal process, the certificate will be granted to the applicant.

This is called as unmarried certificate, which is not given by any state in India other than the state of Punjab.

Since you belong to Kerala, you can give an application to the jurisdictional Tehsildar's office requesting to issue a certificate to confirm your marital status.

The Revenue department will enquire about your marital status through its revenue officer/village revenue officer,and you may even be asked to give an affidavit confirming your marital status, after which the revenue officer may give a report about this to the concerned Tehsildar, who will then furnish a certificate stating that on enquiry it was reported that you are not married and that you reside in so and so address with your parents/relatives  since your birth or from so and so year onward.

The certificate given by the Tahsildar may solve your purpose.

- In Punjab for getting the said certificate , you need a residential proof , and not any state is issuing such certificates in India. 

- However for registration under the special marriage act, you should perform your marriage as per religious custom and ceremony and further after getting the certificate from the church there you are produce the same for registration . 

-  Further, if you both are residing aboard , then you can registered your marriage under the Foreign marriage act as well, with the help of Consulate of India.

There is no rule regarding marriageability certificate in the State of Kerala, only this certificate issued by the state of Punjab as per rule framed by the state of Punjab to safeguard the people from cheating because there are so many people who are already married and solemnized their second marriage by hiding these facts from the authority.

A single status certificate is sufficient for your case.
