• Due payment not receive from other compnay

Dear Sir, 
we are from Gujarat based compnay and my client from Faridaba. we supply material to my client before 10 months ago. now we are asking for due payment so he will not make payment.

so how can i get my money back and if i want to go with legal action so how ?

Did you have any agreement with the other party? The contract will help you in claiming your money back. 

If not then you have given him materials and you may be having receipts of it. File a suit for recovery of money.

1. Obtain Cheque for the due amount from your client and credit the Cheque into your account. If it's dishonoured, file a suit against your client U/s. 138 of Negotiable Instruments Act.

2.  You can send a legal notice to your client for recovery of your due amount and if he doe not pay your amount due, file for a recovery suit in the jurisdictional Court.

Dear Sir,

1. Please look into whether a valid agreement/contract has been signed between you and your client. If there is a contract and he has breached the contract, then you may sue him.

2. Order 37 of Civil Procedure Code: This order is a power given to the person who wants to recover his money. This order permits creditor to file a summary suit. This order comes under the speedier trial. Once the suit is filed and summoned.

3. Appropriate remedy for you is to file a suit for recovery. the case will be filed on the basis of your invoices, receipts and other documents available with you. the matter may take anything around 1.5-2 years. you will get interest along on principal along with principal amount and also cost for proceedings.

File a complaint with local police of cheating and criminal breache of trust 

Once FIR is registered you can expect your money back soon. 

Another option is to file civil suit for recovery.

You can file a suit for recovery of money against sale of goods.  Issue him lawyer's notice  seeking payment with interest as mentioned in bill/invoice within 15 days and after that file a suit at your place of business.
