• Change of date of birth

My eldest brother DOB is 01/08/1968,and another my elder brother DOB is 01/04/1967 iam is the last my DOB is entered 01/111967 is it possible take birth biologically within 6 months of my brother plz guide me to change the DOB legally

It is not possible to change date of birth once recorded in document and education certificate  but you can obtain new birth certificate  as your birth is not registered. Following is the procedure under Births and Death Registration Act for obtaining birth certificate …

  1. Apply to municipal authority as per the date of your actual birth. Municipal authority will give a certificate that no such birth is registered on that date.
  2. Submit an application to the Executive Magistrate/Tahsildar for direction to municipal authority for birth certificate  on the said date with following  .
  3. A notarized affidavit stating that you birth took place at home on the said date and the same is not registered.
  4. No birth registered certificate issued by municipal 
  5. Notarized affidavit of mother and father stating that you birth took place on that date and it is not registered.
  6. Executive Magistrate/Tahsildar will give direction to municipal authority for issuing birth certificate.
  7. Take that direction to municipal authority and apply for birth certificate  on said date.
  8. You will get required birth certificate on payment of Rs. 50/- fee to municipal

do you have birth certificate issued by muncipal corporation 

 

2) if wrong date of birth is mentioned you can change date of birth in BC by applying to registrar of birth 

 3) to correct birth certificate you need evidence that you were born on x date

4) hospital discharge certificate would prove you were born on x date

You cannot change the date of birth registered in the register for births and deaths held by the local civic authorities.

You first ascertain that if your date of birth is correct as per the birth records  to that of the date registered in the register for births.

If you find any discrepancy in the dates registered in the birth register and to that of the actual date of birth, you may gather evidence for the true and actual date of birth and file a declaration suit before civil court to get your date of birth declared as per the documentary evidences you submit before court and seek a direction to the registrar of births and deaths in the local to rectify the correct date of birth in the register held by the authorities concerned,.

Unless you were born premature, birth is not possible in 6 months. 

 

It seems your DOB has been recorded wrongly, your parents would be knowing better. 

 

If the said is recorded in your matriculation certificate it is adviced not to get it changed now.

- If you having the proof of your correct DOB , then legally you can correct the same from the office of birth registrar .

- Further , if not having any proof for the same , even then you can correct from the said office after submitting the residential proofs of your parents including you.

1. The DOB cannot be changed on the hypothesis that biologically the mother cannot deliver another child within 6 months.

2. You can get the DOB changed only if you can prove through some documentary evidence that the DOB is erroneous.

-     To change DOB after so many years will be almost impossible at time of retirement.

 

-     Even if you will make new birth certificate, you have to change all documents and also your department will object to it.

 

-     You need very good evidence to prove the correct date of birth.

1. Purchase Application form for Correction of Birth / Death / Cremation certificate from Birth and Death department of this municipality for Rs. 10/-.

2. Submit the filled application form to the Birth and Death department. 

3. Applicant must attach the following documents along with the Application Form –

  • Photocopy of Birth / Death Certificate issued by the Doctor.
  • Photocopy of Birth / Death Certificate issued by the Hospital / Nursing Home.
  • All Original Birth / Death / Cremation Certificates that were issued earlier must be submitted.

4. Submit the requisite fee as per the Rate Chart into the cash counter of Barrackpore Municipality.

5. Corrected Birth / Death Certificate will be issued within 15 to 20 working days.

This cannot be done legally and it is not possible biologically. You cannot change your date of birth now after so many years. An affidavit has to be filed but still the Government would ask you about the delay.
