• How do I pay customs penalty via RTGS/NEFT?

I had made an online purchase of an item prohibited under Section 112 of Customs Act. I have now received a notice saying that a penalty of Rs. 5000 has been imposed. In the notice I have been instructed to draw a demand draft in favour of "RBI A/c. Commissioner of Customs, Kolkata" and submit/deposit at the office of the undersigned.
My question: As it is not possible for me to physically go and deposit the demand draft at the Customs office in Kolkata, is it in any way possible to pay the penalty online? If yes, where do I find the RTGS/NEFT details?

This msy be a fraud. Usually they issue a show cause notice and call you to be present in person.

Since you are not able to deposit the DD personally  you may send  the same by registered post with acknowledgement card to the customs office. 

If there was any provision to remit the fine amount through RTGS, you would have been informed about it, since this is to be paid into a particular account,  you may not be able to remit the amount by any other mode.

This may be a fake notice because before imposing penalty due hearing held and no direct penalty. Demand name is also not looking valid.

- As per the website of Chhatrapati Shivaji International Airport, Customs displayed a list of items that are prohibited for import. Pornographic and Obscene materials are covered under Prohibited items of this list , and under section 111(d) of Customs Act, this item is liable for confiscation and is also liable for penalty u/s 112 of Customs Act, 1962.

- Further, the Kolkata High Court addressed the issue whether sex toys sold in India comes under the charges of “obscenity”. The Court held that the charges on obscenity cannot be held as they were not legally sustainable. Just because the toy brings out sexual desires, it cannot be labeled as ‘obscene’

- Further, keeping the items having for personal use, is not an offence unless the individual is private about its usage and functioning. Every individual has his/her private life and hence, they have the full right to do whatever they want to under those boundations.

- Since, you got notice from Custom Department; hence you should give the reply of the show cause notice to the department and appear for personal hearing, and thereby declare before them that the said items are for personal use and not for sale to other persons. 

- Hence , check before paying the said amount .

1. You shall have to enquire from the Customs Authority whether they have started accepting online payment towards penalty.

You might have ordered a toy from Ali Express. The item will be confiscated and penalty will be imposed on you. Notice  is issued to you under Section 124 of the Act and you have the option to pay fine under Section 125. The offence is compoundable under Section 137 (3) by Chief Commissioner of Customs. A penalty of 5K is imposed and item is confiscated. Everything can be done without visiting the office of Customs. DD can also be sent by post.  You can pay the fine online and get out of it. Sometimes Section 194 of Indian Penal Code, 1860 is also added. But after payment  of penalty the  matter is closed.

You can pay this penalty through the Challan in the bank. 

You have to check the list of banks in custom department website. 

After the payment through Challan you can present the copy to officer concerned.

Dear Querist

If you are ready to pay the penalty imposed by Custom Department then you should send a reply to the notice with your request to provide the account details or you may also ask them about the delivery of the item and you will pay the penalty amount at the time of delivery, if possible, they will inform you accordingly.
