• Two people together Purchasing Agricultural Land in Karnataka

Me and my relative together like to buy 5 gunta agri land near A city in Karnataka. We both are from agri culture family. In future , we like to convert that land to Non agricultural purpose. After conversation we like to do partition deed to make two 2.5 gunta NA land. That land comes under gram panchayat. Not under city administration . One developer divided his big agri land into many small agri lands . Each small divided agri land has different survey number. We are planning to buy one small agri land among them. Already at least 25 such small neighboring 5 gunta lands are converted for non agricultural purpose. Constructed home too. My questions are below
1. Can two relatives or friends buy agri land together as co-owners ,If they are from agricultural family?
2. If only family members can buy agri land together, how close relation should be to become eligible to buy agri land together?
3. What are the important criteria’s should be satisfied by agri land for become eligible converting it to NA purpose?

2) following documents are required for conversion 

 

  • Proof of identity of the owner.
  • Copy of the sale deed.
  • RTC (record of rights, tenancy and crops).
  • Copy of partition deed (in case the land has been inherited).
  • Mutation documents.
  • Nil-encumbrance certificate.
  • 7/12 extract.

1. Yes, it's possible for two relatives or friends buy agricultural land as co-owners, even if they are not from agricultural family, in view of amendment to the Karnataka Land Reforms Act, which allows even non-agriculturists to buy agricultural land without any prior conditions.

2. There's an amendment to the Karnataka Land Reforms Act by which anyone can buy agricultural land in Karnataka and the earlier clause that only an agriculturist with certain annual income could buy agricultural land, has been removed. No need for only family members to buy agricultural land.

3. If the land is in yellow zone ( which is reserved for residential purposes ), then the agricultural land within it's territory can easily be got converted from agricultural status to non-agricultural residential status by approaching the statutory authorities, including the jurisdictional Deputy Commissioner/BDA/BMRDA and paying the statutory fees.

Dear Sir,

1) Yes two relatives or friends can buy Agricultural lad together.

2) Now any Indian, or a trust, society, company or an educational institution can buy farmland in Karnataka regardless of the buyer's annual income from non-agricultural sources. Thus being from agri family is not a need, regardless of it you can buy agri land.

3) In Karnataka, the Karnataka Land Revenue Act 1966 has prescribed the procedure to convert agricultural land to non-agricultural, under Section 95 of the Act.

The purpose for the change in use of land must be specified. The Deputy Commissioner may grant permission and may even impose conditions. The law prescribes a penalty in case of violation of the procedures.

4) Conversion involves seeking the approval from the competent revenue authority which is the Collector, Sub-divisional Officer (SDO) or Tehsildar. The process can also be undertaken online through govt site.

1. Yes, legally you can purchase the agriculture land in the name of two relatives , specially being from an agriculturist back ground .

2. You can purchase the land in joint names as well.

1) Yes, two relatives or friends can buy agri land as co-owners.

 

2) It should be blood relation in the close family. But the land you are purchasing it already NA plots and not agri land as of now. It is a plot.

 

3) The agri land is not usefully for any cultivation now a days and can be good for commericial purposes you have to provide a valid reasons.
