• Adverse police verification for passport while living overseas

Hello Sirs,
I am living in the USA since 2016 and I am applying to Canada for Permanent residency. I need to submit a police clearance certificate (PCC) from India as a document for processing my permanent residency application. I came to India in November 2020 for 3 weeks vacation and applied for PCC at the Chennai regional office in person. PCC was initiated after I left from India and so the Police couldn't verify my physical presence due to which adverse report has been given. I received a letter seeking an explanation for the suppressed information I have provided in acquiring the passport and also to surrender my passport in 21 days. But while acquiring the passport I have provided the original bank statement of the current address as proof and did not provide any false documents. I have reinitiated PCC through the Indian embassy in the USA but awaiting the results. So can you please advise me as to how can I approach the officials and get this issue sorted out as I am back in the USA.

1) adverse report has been generated as you were not physically present at said address 

 

2) if you have  re initiated the process come down to India and remain present at address mentioned in passport

You knew it very well that it would be time consuming process hence you should have arranged your program accordingly.

In India until and unless you follow it up till the end you are not sure of the relief you have sought from the authorities concerned.

If the police is reporting that you are not available in the address given at the time or procurement of passport to the passport authorities, then the passport authorities will certainly take action as per law.

You may now have to provide the documentary evidences to establish your genuineness before the authorities concerned.

You have stated that you have  already initiated the process through Indian embassy, what is the result of that, if it is taking little more time, then you may have to wait  and cannot jump into any hasty conclusion as you did earlier, which will result into a fatal result once again to you. 

You may wait for the action taken by the authorities concerned on your application re-submitted.

You did a mistake by not leaving India before completion of PCC.

Now send any of your near relative as authorised representative with written explanation and documentary proof to establish that no forgery or crime was done.

if it is not accepted then filing he writ petition is an option.

You physically or one of your family member visit the concerned thana from where the report has been from the ground, first see what adverse they have given, consult them and convince them, they will give second report which will work as good as required for the purpose.

You need to approach them on ground of inadvertent error in the said matter. The said thing will be resolved by authorities on this ground

1. A negative report was inevitable if you were not physically present at the time of police verification. You ought to have initiated it only when you were physically present in India.

2. Since you have reinitiated the process through Indian Embassy you need to wait for the culmination of the process. If PCC is still not granted then you can file a writ petition in the jurisdictional High Court in India.
