• Selling property in Chennai - life certificate

I am an NRI residing in U.S and have given P O A to my friend in Chennai to sell my property and I have to send him my Life certificate obtained from my family physician in U.S. 

Would you please provide me with the format of Life certificate which would be valid in Chennai for getting it signed by my family physician here.

The sale on the basis of POA is not valid unless the attorney is his close relative or the agency is coupled with interest. 

So first check whether the buyer would be ready to buy on this kind of POA.

I'd the POA is recent then there is no requirement for life certificate which does not have any specific format.

There's no such format available. 

The medical examiner shall furnish a certificate stating that on examination he found you to be mentally sound. 

If necessary you can get the medical certificate notarized by a local notary public and send it across.

No particular format is there

The doctor has to simply state on his letterhead that you are alive

He has to sign the letter and put his stamp on it

To such letter your photo ID (preferably Indian proof like PAN or Aadhaar card) can be attached (preferably a certified true copy duly certified by Indian Embassy or Consulate) and the doctor can further write that you showed him the photo ID and the person in it and the person  before him is the same. 

Not necessary that such a live certificate be given by only a doctor. Any person like a public notary or any person from the office of Indian embassy or consulate(preferably) can also give this certificate 

Additionally an certificate can be obtained from the local Municipal Corporation in your residence city in Chennai stating that no records are found on the death register for a person named so and so (that is you). This should allay all doubts in the mind of the sub registrar 

In my view the sub registrar is doing the right thing by taking adequate protection which is really a good thing in view of the scams by which properties of NRIs who are dead are sold using POA by unscrupulous people

Original certificate doss not require notary. No special format. Physician will issue the life certificate in general form that person is alive and living at this address. 

Get it attested at Indian embassy.

- Being an NRI , you can give POA to any relative or nearest one for executing Sale deed in favour of purchaser on your behalf. 

- The said POA should be notarised as per rule of USA , and must be attested by the Indian Consulate in USA . 

- Yes, you can collect a certificate from the Doctor , wherein he should mention that you are mentally perfect to assign the POA , and further unable to travel to India for the specific purpose.

1. Hope your POA has been properly executed and attested by the appropriate officer of the Indian Consulate and thereafter has been validated by the Collector by affixing stamp of Rs.50/- thereupon.

1. Such certificate is not asked to be produced in all States.

 

2. Even after the said certificate is issued, the person can expire and in that case the sale will become invalid since the POA will become invalid after the demise of its executor.

 

3. In case of pension holder also life certificate once in a year is taken.

 

4. However, a simple  certificate issued by the Doctor should serve the purpose.

POA holder should submit proof to the sub-Registrar that the Principal is alive. For this, a Registered Medical Practitioner or Gazetted Officer can issue a Life Certificate. These certificates are valid for 30 days only.
