if you prove it before court then she can not claim maintenance.

meri shaddi jan2013 mai hui thi. lakin muje nahi pata tha ki ladki ko bimari hai. 2 month baad muje pata chala tho mane ladki ke father se treatment ke paper le liye jo ki unhone badimuskil se diye. ladki 15 sal se bimar hai or unhone humlogo se chupaya tha. use mirgi ki bimari hai or other bimari bhi hai. hum logo ne doctor ko dikaya lakin doctor ka khena hai ki vo hamesa asehe rahegi or pregnancy bhi nahi kar sakte jab tak dawa chal rahi hai. uske baad vo aapne ghar chali gai fir jab vo aai tho humne use ghar mai nahi liya. or usse phle sec 12 laga di lakin uske baad unhone mere or mere parivar pe 498 A laga diya or 125 bhi laga di. sec 12 mai vo log aa nahi rahe hai. plz muje bataye ki unko bulane ke liye hum kya kare or 125 mai maintanance na dena pade or case mere faver mai aaye. or unko frod ke liye saja hoye. plz give me a answer Regards Pratik Upmanu 09685088898

1) aaap ne section 12 of HMA ka case kab file kara ? annullment ka application aapko ek saal ke andar karna padta hai .
2) agar aap ki biwi ko mirgi ki bimari hai us ke karan aap ko annullment nahi milega . you can no longer annul your marriage or seek a divorce on the ground that your spouse is suffering from lunacy by virtue of being epileptic
3) aap ko 498A case and 125 Cr Pc merits par ladna padega
Sec 12 of HMA ka case mane Aug2013 mai file kiya tha. agr sec 12 ko withdrawal kar ke sec 13 of HMA laga diya jaye tho sahi hai kya. Sec 125 mai koi bhi sambavna nahi hoti na dene ke liye . agar job chod di ho tho uska bhi fayeda nahi milta kya

1) ok . aapne 1 year ke andar section 12 HMA ka case file kara hai
2) aap agar section 12 with draw karte hain aur section 13 HMA file karte hain tau bhi divorce on grounds of mirgi ki bimari nahi milega
3) section 125 Cr Pc me agar aapki biwi kaam karti hai tau usko maintenance nahi milega . us ne job chod diya tau aap court ke samne uski pehle naukari ka zikar kar sakhte hain
1. Annulment will not be ordered in your case as the lunacy of wife is not a ground to seek annulment of marriage. If she is not appearing to contest the case then court notice may be served in alternative ways. The judge would himself specify at the next hearing or on the hearing after that the manner in which she may be compelled to appear.
2. What is the employment status of your wife? If she is employed then she is not entitled to get any financial support from you. Maintenance will be ordered only in the event that she is unemployed.
As regards sec.498a the only legal remedy is to contest it on merits having regard to the allegations she has leveled against you. If she has left the job in order to extract maintenance from you then you may bring this fact to the notice of court.

still court can order maintenance but it will be reduced & will as per your income
haan court de sakhti hai maintenance ka order . biwi ko maintaiin karna aap ki responsibility hai . biwi agar kaam karti hai tau nahi dena padega maintenance
If you are not employed any more then the amount of maintenance may still be ordered, albeit it might be nominal having regard to your unemployment status.

haan biwi ko court maintenance dega . mirgi ki bimari curable hai . us ke karan na court aap ko divorce dega na shaadi annull karega .
tho fir aap he bataiye ki hum divorce kase le sakte hai or maintenance kariz kase karwa sakte hai plz tell......

Agar aap fraud sabit kar bhi do tab bhi biwi ko maintenance to dena hi padega.
