Though changing of trade name is not essential even if the trade is changed, if your present organisation doesn't give with your previous trade name like having suffix of Hospital then it is better to change the same.
For running a medical practice your individual identity is enough.
As per law, you have to inform all authorities under notice that you have changed the name of your organization and reduced the number of staff as per your requirements.
After intimation, all concerned authorities would visit your organization and make reports to that effect to exit your organization from statutory payments which were applicable prior to change of name of organization and staff .
Notice to all statutory bodies are necessary to stop making payments to them as per Acts and rules. EPF etc.
Purpose/work of firm enters in the record while registration of partnership firm. If you are changing the business of firm than have to apply for amendment of firm purpose.
Your firm is not registered , PAN will not change.
No role of EPF office. If you have applied for EPF than withdraw it.
- As per the Act , an epf account is mandatory for all employees with a basic salary up to Rs.15,000 per month in firms employing more than 20 workers.
- Since, there is only 2 employees , then you not come under the rule of epf.
- Further , as you have closed the firm where it was applied , and further running consultation only, then you should change the old name , otherwise there may be trouble .
- Yes, you should also apply for new PAN Card with a new name.
You have to change the name of the firm by adding "new" in old one, otherwise old one will remain in record of the departments and they will take action accordingly.
If you have closed the establishment and surrendered the license then your previous establishment is virtually closed or not exiting.
In that case where is the question of running the clinic in the same name.
You may better change the name of the clinic to avoid the EPF or any other problem by continuing the business in the same name.
Once the partnership firm is dissolved the PAN pertaining to the partnership firm stands automatically cancelled.
Therefore you may have to apply for new PAN
Dear Sir/Madam,
You are suggested to change the name and pan card everything which has resemblance with previous name.
If you have stated this and have closed tgen you don't need to change it. You can carry on with the name.
No the name even if changed will have the same PAN card if it is a proprietorship firm. A company may have a separate PAN card.
1. You are under no compulsion to change the name of firm.
2. You can continue to operate under the original name.
3. PAN also does not have to be mandatorily changed.
1. You should make a new firm with different name because EPF will be applicable on previous firm whether you have required number of employees or not.
2. You also need to get PAN on name of new firm and get the previous PAN cancelled
