On father death your step mother , you and your siblings would be legal heirs

2) step mother can during her lifetime bequeath property to whom soever  she pleases

3) on her demise intestate property would devolve on her legal heirs

Your father can not transfer his ancestral property to his wife alone depriving his own children.

Therefore you still have share in the property and to enforce your rights therein you can file a suit for partition.

Your share in the property is still subsisting and do claim your rights.  If you don't receive it then file the partition suit immediately.

1. IF Step-Mother is legal wife (means married ONLY after death of first wife), only then she is entitled to EQUAL share in "ancestral property".

2. Ancestral Property means property which is atleast four generations old. IF partition of ancestral property was done then it does not remain ancestral property, but becomes "self-acquired" property of each partition holder /beneficiary.

3. "ALL" the residual Legal Heirs, shall have EQUAL share in ancestral property. Only one single person CANNOT claim entire ancestral property.

4. IF Step Mother also expires THEN her particular share ratio shall be EQUALLY divided amongst "ALL" children of first and second wife of Father.

- If your father died without leaving a WILL , then his property would be devolved upon you and step mother equally.

- Further if the property is an ancestral , then WILL having no value and the share will be equally.

- You should ask for your equal share in the property left by your father.

- If , refused , then file a Partition suit before the court for getting your share .

- Further after getting her share in the property it will be her self acquired property , and she will have right to transfer the same to anyone without other consent.

- Further , after the demise of step mother her property would be devolved upon you and other siblings if any.

The ancestral property belongs to you and your step mother. You have a share in it.  How can an ancestral property go only to your step mother and not to you.

If your father is reported to have died intestate then the properties left behind buy him shall devolve equally on all his legal heirs including your step mother.

Hence you can claim your legitimate share in the property as a right even now.
