• Refund of lost amount

As per information given by general secretary of indian floorball federation, new delhi our students got selected for international game who participated in nationals. For expenses with the help of state coordinator he collected one lakh from each student. But because of his misguidence, their visas got rejected our students didn't attend event. But finally we came to know that he chested us. So we filed fir against state coordinator and general secretary. Now federation committe members are asking for fir copy which we filed so that they can take action on general secretary and made our amount refund back. Is it legally ok to give fir Xerox copy to the third party.please kindly suggest us how can we get our money back. Fir was booked one year back but still no progress what should we do .

No harm giving FIR copy to committee members but keep close eyes on them. They may go for quashing FIR before High Court or Anticipatory bail before Sessions Court. 

You can file suit for recovery of dues against them before Civil Court.

- Since, the FIR already lodged against the state coordinator and general secretary , then a copy of the same can be forward to Federation Committee for further action legally. 

- Further, as there is no progress , then you can file an application before the magistrate for knowing the status of the FIR , and the court is bound to call a report from the I.O. of the case. 

- Further , separately you can also file a recovery case against them before the court as well.

Please take note that FIR is a public document and anyone can get its copy from the court even if you don't share it with anyone else. 

Therefore you may feel free to handover the copy of FIR 

The criminal case doesn't ensure your money back unless recovered by the Police. 

To get back your money you need to file civil suit for recovery of money.

There's nothing wrong in giving the photo copy of the FIR, if the authorities take any action in this regard and provide you the desired relief then you can proceed.

There is no harm in giving  a copy of FIR to the members of Federation Committee.  However, it takes time to get the trial started in the court on the basis of FIR.   Once FIR is lodged, it is the matter of the State Govt. and the accused.  Complainant is only called for witness only.   During the trial,  there is possibility that some compromise took place between you and the accused  and he may return the money but for that also you have to get the FIR quashed from the High Court after compromise.

 

Asking for copy of FIR and assuring to take necessary step by the members of Federation Committee is a good gesture and may bring good result.  Be optimistic.  Good luck.

1. There is no legal harm in giving police FIR copy to ANYBODY, more so specifically since police FIR copy can be download from Police website and also hard copy can be obtained from police station via an proper application, by anybody.

2. The law provides that police must file Charge Sheet in years time, after which the FIR becomes infructuous and charge sheet cannot be filed.  Hence you need to followup using the services of a local criminal lawyer and file a private criminal complaint.

3. For Recovery of amount, you will need to file local Civil Court "recovery suit", without which money cannot be recovered.

One year means investigation officer has colluded with them. File application court to remand progress report. Complain to commissioner in writing against IO.

Hi 

1) Since FIR is a public document, you can give a xerox copy to the Federation committee members. 

2) Also, if you are unhappy with the way case has been investigated by the police,  victim's file a writ under Article 226 and ask the High court to direct the police to investigate the matter and file charge sheet under law.

3) Also you can ask the High court to monitor the case given that it is a matter of both player(victim) and public interest (since the federation is an administrator for floor  ball as a sport in state of Andhra pradesh. 

4) Also, since the fraud is committed by a sports organisation , court can direct the Federation or Ministry of Sports, Government of India to compensate the victims for their financial losses.
