- As per Supreme Court , GPA is not an instrument of transfer in regard to any right, title and interest in an immovable property.
- Further, directed the municipal bodies not to register or mutate any property based on the GPA documents.
- Hence , after getting the property from him through GPA , legally you cannot sell & transfer the property after executing sale deed in another name .
- If he giving that property without any amount , then he can execute a registered Gift Deed in your favour.
- But, if you are paying him , then he should execute a Sale Deed in your favour.
