• BBMP approval for building house on B-Khata plot

I am evaluating a property for purchase in Bangalore. This property is in a gated community where adjacent plots have been constructed and converted to A-Khata. However, this property is still under B-Khata. I plan to construct a house on this property for self-use and would like to know if BBMP provides approval for house construction on B-Khata property?

Also, what are the other legal issues, if any, with constructing on B-Khata property?

Kindly get correct Khata number for your plot from Revenue Department or Collector office and later on you can proceed for constructing new house on it because you should not face any further consequences for getting loans, new water connection, electricity etc.

For 'B' khatha, BBMP does NOT approve building plan. Banks do not give loan if building plan is not approved. BESCOM and BWSSB require BBMP approved plan for issuing electricity and water connections.

1. BBMP does not provide plan sanction for the building to be constructed on "B" Katha property.

2. There is no such thing called "B" Katha and in usage of words by the common people, whichever property was not given "A" Katha by the BBMP, but an extract of entries made in "B" Register after collecting tax by the BBMP has become "B" Katha in the colloquial language.

3. If you construct a building on "B" Katha plot, likely that the property may be regularised by BBMP  after collecting betterment charges, if Akrama-Sakrama scheme comes into operation and chances of conversion of your property from "B" Katha to "A" Katha. The Akrama-Sakrama scheme has been stayed in the Hon'ble Supreme Court. If the stay is vacated, the State Government in all probability may implement the Akrama-Sakrama scheme.

You need to convert it to A khata property/ regularize to get the legalities in place. Your property will always be considered partial illegal being in b khata. You can seek permission of the same from bbmp but they will be reluctant.

The B Khata owner doesn't have valid title in the property. It means the property is illegally and or the building is constructed without building regulations. The property tax may have been cleared or collected in future. 

B khata owner can not apply for license to run business like trade license nor can apply for loans from bank. You can not apply for electricity or water connection either. 

However there is no restrictions in place while buying or selling this property. 

So decide accordingly.

Building or property having only a B Khata is an illegal property. So it is better to first get the land converted into A khata than only purchase or construct.


B Khata is issued to properties that are in violation of building byelaws and government norms and have pending property tax dues to be cleared. This is a temporary certificate which needs to be converted to A Khata by paying betterment charges or conversion fees to the concerned authorities.

- As per the Karnataka Court, a building or property having only a B Khata is an illegal property. 

- Further, a person cannot sell or resell his property with only a B Khata.

- Further , B Khata is a temporary document while A Khata is the permanent one, hence generally Bank not issued loan on B Khata. 

- However , one can convert B into A Khatha after applying before for District Commissioner Conversion.

You need to approach office of the District Collector and Magistrate to follow up the procedure for conversation and regularisation of A and B Khata in consonance with BBMP permission and process of seeking permission for the construction of house,bungalow and commercial shops, offices and activities.

1. You may apply to BBMP thru a registered architect to get approval of your construction plans. Since adjacent plots have received construction permission, BBMP would have no alternative but to sanction your construction plans.  Do not construct without sanction letter of your construction plans.

2. Similarly the property would also be converted to A-Khata, as a precedent to the B-khata plots that have been converted to A-Khata, more so you cannot be discriminated against by the authorities.

no you won't get plan approval. But basically the point is that you are not allowed to build on that plot as of yet. Once they issue A Khata then you are allowed to build there.

B khata is not a valid khata.

If BBMP do not approve construction plan for B khata property you cannot do anything legally on it except to adopt some illegal means i.e., bribing the authorities concerned, which is always a danger like a sword handing on your head permanently.
