• Want divorce

Hello sir
Mene pehle vi post upload ki thi Meri marriage march,2020 ko hui thi. Mein govt job krta hu aur probation period chal raha hai. aur meri wife muje bolti hai ke tum muje psnd nai. meri toh kise aur ke sath setting thi..ab muje proof v mil gye woh apni frnd ko message mein bolti hai ke mene apne husband ke pass nai jana. Muje woh gher jail lgta hai. Aur message mein muje gali v deti hai ke mera husband lofar hai behanchod. Son of bitch. Mere uper false ilzam lga rahi hai...kal panchayat mein dono parties ayi thi jisme meri wife bolti hai ke mein husband ke sath reh kr khush hu aur dusri side frnd ko bolti hai ke mein waha nai jana chahti.. panchayat mein wife ka brother aur dad bol rahe thy ke hum tumko goli mar dege aur job v nai krne dege jiski meri pas audio recordings v hai... aur bolte thy ke police ke sath hamare link hai aur woh police SP hamare relative hai....

Mera question hai:-
Kya mein high court se direction le skta hu ke police mere ko arrest na kre aur mere sath koi jabrdsti na kre .... kya eska
muje benefit hoga ?

Kya mein SSP ko complaint kru ke ladki ke brother aur dad muje dhamkian dete hai ke hum tuje mar dege ?

Kya police muje ghr ya Office se arrest kr skti without any notice or sitting ? Ya fit sitting par bula kr arrest kar skti hai ?

Ya fir blanket bail apply kru ? Kya court usko pass kr degi ? Agar kr degi toh kya process hai?

Ya fir kus v na kru jab woh police ke pass jayege toh police ko sab proof dikha du ?

1. if FIR is registered then you can apply for anticipatory bail from high court or sessions court to evade arrest.

2. Once you get such order your fear for other things as mentioned here is gone.

3. So once FIR is registered immediately apply for anticipatory bail by getting n touch with an advocate of your choice.

High court se directions aise nahin milenge. Aap pehle divorce petition file kijiye....taaki case aage badhe. Phr agar yeh log FIR karte hain to phr high court jaa skte hain.

SSP ko bhi notice de dijiye. Agar yeh log FIR karein to anticipatory bail ke liye apply kijiye.

- Is tarah ki family ki dhamki , cruelty me aati hai , aur aap is recording ko court me bhi pesh her sakte ho .

- Abhi jabki koyi FIR apke khilaf nahi hai , to High court direction nahi de sakti .

- Jab police se call aaye to hi session court se bail mil jayegi .

- Police FIR kerne se pahle appko notice bhejegi , bina dar ke waha jana hai , arrest nahi ker sakti police, chahe uske father hi kiyun na SSP ho.

- Han , aap ko inlogo ke dhamki ke khilaf ek complaint police me dena chaihiye ,puri bat likhker ke wo pasand nahi kerti aur audio ki bate likhker apni safety ke liye ,, aur ek copy SSP ko bhi bhej de.

- Nahi , bina FIR ke  arrest police nahi ker sakti . Aur FIR ke bad police khud phone ker aapko batayegi ki aapke against FIR kiya giya hai . Bail le lo warna arrest ho jayoge.

- Jab tak , wo koyi complaint apke khilaf nahi degi , court se blanket/anticipatory bail nahi milega aur application dismiss ho jayega.

Without any case registered against you no case from your side will be entertained by high court either for not to arrest or even for anticipatory bail.

You can very well lodge a criminal complaint against her father for his illegal threatening acts.

The police has to notify you about the complaint lodged by her then only they can take any action to arrest yo after inquiry is completed, however if her father is influential then he may bribe the police and put pressure on them to arrest you without giving you a chance to get anticipatory bail also.

You can make police station against them under CrPC for "Attempt to Kill" , threatening, etc. So if tomorrow any happen with you in your life these people are responsible.

And ask girl to go from your life if she want to live with boy friend ask to run away from home and live with that guy. If she has guts she will do otherwise keep quite.

My advice to you is keep collecting all the materials against your wife and father in law for future use.

Police can not arrest you in family matter directly because Apex Court has clearly mentioned about dealing with the matter of Domestic Violence reported by wife against the husband.

In case of complaint by your wife against you ,Police are bound to give you notice .

Based on that notice approach Sessions Court for Anticipatory Bail application and attach all evidence for your success.

Blanket order can't be granted by any court in India.

Your relief can be granted by Sessions Court, hence no need to approach High Court.

You may file a Complaint ,in writing , to Local Police and Copy to SSP citing threats to you by your Father in law and in-laws during proceedings before Punchayat.

If Police and SSP do not take action of your complaint then approach nearest Judicial Magistrate for direction to police to register your FIR against your in-laws.

If your wife doesn't want you with her as life partner and she is in love with other man prior to your marriage then file divorce before Court on the grounds of adultry and am sure you would succeed.

This way you can out wit your  wife and in-laws legally and hold your head with pride.

No threat to you and your job.

All the best and Good luck.

Since, the family members of your wife threatened you and also you have recording of the same, you can file complaint against your wife, her brother and father for intimidating you.

You need to submit the copy of recording of their threats to support your complaint.

If the police refuse to register FIR, you can file private complaint U/s.156(3) Cr.P.C.seeking direction from Magistrate against police to take up the case, investigate the same and to submit report.

Without notice they cannot arrest you.

If any false case is registered against you, you obtain Bail, thereafter, go for Quash of the FIR.

1. Bina complaint file hue aap kis cheez k liye petition daaloge ki apko arrest na kiya jaaye. Haan agr wo koi complaint file krte h police station me to aap anticipatory bail lga sakte ho sessions court me.

2. Haan jarur krni chahiye aapko complaint ki agar aapko kuch hota h to uske zimedar wo Log honge.

3. Police aapko directly arrest nhi kr skti unko notice dena hoga apko. Pr agar apke in-laws influential h to police kr skti h arrest but wo legal nhi hoga.

4. Abhi koi benefit nhi hoga blanket bail apply krne se.

5. Apko wait krna chahiye.

AAP apni complaint wapas ley sakte hain.

App apni complaint wapas naa ley toh accha hai.

SHO ke paas rahney dain enquiry complete honay dein.

Complaint wapas lenay mein disadvantage hai.

Divorce file karo aapsi sahmati yaa character ground adultry par file kardo aur divorce lena tumhare liye thik hai wife Kaa affairs hai toh divorce thik hai jald lein.

Don't withdraw the complaint at this stage, it may become a farce to you at a later stage when her advocate cross examines you about this and would establish that you have leveled false allegations against her.

If you think that after she coming to know about the details of all the  evidences you have s submitted before police, she may come out with a different story once again.

It is not so, firstly she will try to defend her interests instead of planning more crooked things against you.

You go ahead with the present complaint and also be prepared to produce more evidences if she is trying to cook up up new stories.

Dont be under any presumption or assumption about her next possible moves.

You may concentrate on your case alone and not on hers.

Behtar hoga ke Aap apni Complaint wapas hi na le. agar aap ko wapas lena hai complaint to aap le sakte hai.  agar In Future aapki wife agar suicide karle to aap pareshani mein padh sakte ho. isliye wapas na hi lena behtar hoga.

No need to take your complaint back.

If it reaches the police, just they will ignore.

Let it be there with police, if you have copy / acknowledgement of same, it is enough.

It will help you, going forward, if they file any false case against you.

Your  complaint with proofs will be on their records first.

Don't worry.  Leave it.  Try to collect some more proofs, if possible.
