• Wife and her family threatening

Hi All,
I got my married last year and it was an arrange marriage. My wife and his family members started threaten me and my family members saying if i am not coming out from my parents i have to face legal issue. My wife behaviour towards my parents are not good as my both the parents were sick. she started behaving badly with my parents saying ask your son to leave separately not with you guys. You guys are taking my husband salary. She started threaten me saying i should not buy medicines for parents else i will face consequence.
She will ask for luxury living and start saying if you cant do you will face the consequce and you know court will support girls. She always says that you have tie a knot so you have to listen all the things what ever i say.
they family members started threatening my family saying court will support girls and all lawyers will be part of the girl side. Though no mistake from you guy side court will support only girls.
We didnt even meet before the marriage. 
After marriage i saw that there was a weird behaviour that her phone used to get lot of whatsapp message and during a function she was tensed and her what happen and she replied nothing.
she was tensed after seeing a message and she gave me a phone and i can see the pop up message from unknown no saying "Can we have sex chat now "
I asked her and she replied i dont know and i took it casual and said block the no and leave it.
This was coming from different no again and again. 
I said we can lodge a police complain or throw the sim and she said no. I took that also casual and said throw the sim. she was not ready that point of time and In evening she said i feel like "hanging myself".
Which inturn made me scare because 15 days of marriage and she is telling she wants to hang and i thought i have to bring to there notice as it is critical. I didnt even informed my family.
During this time she started fighting to my sick parents saying you guys have to keep us separate which i declined because with out meeting and i married in arrnage marrage and now she wants separate house. 
They family started threaten to us saying if you are coming separately you will end of paying 60 Lac as court and lawyers will support girls. 
She said she had some health issue so i said i will take u to hospital and she replied saying i will go to my parents house and going there she started abusing my parents and me in all the way.
I reached to there family who solely responsible for the marriage and they started telling the same if you are not coming she will ask for divorce and you have to pay 60 Lac.
After that i said i cant take this blackmail any more and please proceed and then they came for compromise and girl entered to my house. With in 1 week again started and she replied to my old age people saying you guys have to serve me in all the way else i will go to court and screw ur family and your son life.
We called there family to have a discussion and they declined it.

If you have decided to opt for divorce, then opt for Mutual Consent Divorce.

 

1.  Better to opt Mutual consent divorce route and mutually the husband and wife can take decisions in the matter of child custody, finance, assets, maintenance or alimony, returning the jewellery given by  your parents and relatives etc.

 2.  In the joint petition to be filed by both husband and wife for dissolution of their marriage U/S. 13-B of the Hindu Marriage Act (Mutual consent divorce) , the custody of child, maintenance, finances, property matters, visitation rights will be mentioned.

3.  The reason can be mentioned as due to irreconcilable differences they have been living separately since one year, and their marriage has broken down irretrievably and efforts to bring about reconciliation have also failed.

4. The time for concluding mutual consent divorce will be 6 months and this cooling period of 6 months can also be waived off in certain cases.

Hi, the incident narrated is mental torture and is one of the criteria of divorce. the girl definitely has married you for money and as narrated her character also is in question. I would suggest to separate from her and also give details to the nearby than so if the girl wants to file a false complaint against you police would be cautious but don't tell about this to your wife. 

Also you wouldn't have to pay 60 lacs she is only blackmailing you

Dear Sir,

You are suggested to file a police complaint against the lady and her parents mentioning that they are blackmailing and threatening of filing cases under women oriented laws. Request for keeping the application in record and give your sufficient time for putting your version of case before any action against you. Also use some audio video recording devices to record all the activities done by her and keep those devices secretly and unknown from her. Also be in contact of some advocate and when you reach a point that you have sufficient proof to proceed against her, move ahead and file the case of separation/divorce. Also, be tact and damn polite during the instances of recordings.

Ask your parents to file a Petition against you and your wife for maintenance. 

After the order,start looking after your parents, incase your wife or her relatives interfere take contempt of Court action against them.

1. It's up to you to take a call as to, whether you want to continue the marital life or not?.

2. In case you want to continue the marital life with her, file for Restitution of Conjugal Rights and in case if the order is on your side and stll your wife does not join you, then her intentional attitude of not joining you itself can be a ground for you to obtain divorce.

3. However if they file cases U/s.498a and DV case, obtain Anticipatory Bail.

 - As per Supreme Court judgement, wife is expected to move in with the relatives of their husbands, follow the rules and customs of their home, and ideally, blend in seamlessly as a new daughter. 

- Further, the court granted divorce to a man on the grounds of “cruelty” after his wife refused to share a home with her in-laws.

- Hence, as per law, she cannot deny living with you, under the condition of separate living from the family.

- Further, If wife is not supporting her husband for the enjoyment of life and denying relation, then the husband can get divorce after filing a divorce petition before the court on this ground.

As per Delhi High Court and Madhya Pradesh High Court judgement , A professionally qualified wife is not entitled to get any maintenance and should work and earn.

 Further, as per latest judgement of Calcutta High Court, An earning woman who has adequate financial resources isn’t entitled to maintenance from her husband.

- And further, as per the Information Technology Act, electronic communication can be produce as a proof in court.

- Messages sent through WhatsApp messaging app are valid legal evidence under law, and the blue tick over the messaging app is a valid proof.

- Further such type of activity without the consent of husband amounts to cruelty . 

- And further , even if she files a case against you , then also court will never grant such hefty amount to her. 

- The submissions mentioned by you , clearly shows that she is playing woman card being wife. 

- Hence, if she lodge a complaint against you and your parents. then your mother being a woman can also file a case against her for the harassment and mental agony under the provision of domestic violence Act.

You have narrated the entire story but have not sought what relief do you expect from her or what suggestions or opinion do you seek from the expert here.

Well, if the situation is intolerable, you may drop her in her parents house for the time being and inform them about her behavior which will affect the relationship if she continues to live with you anymore.

Let them take any legal action as a revenge, you can challenge the same on the basis of merits and evidences in your side.

If they keep demanding money you can make a recording of their demands and lodge a criminal complaint against her parents for the crime of extortion.

If you want to file a divorce case, you may have to wait for one yer from the date of marriage for this.

There is no such thing that the law favors only women or it biased.

Let them blabber anything, don't get scared by their threats or useless rumours.

file a information intimation at the nearest police station regarding the threats for implication in false case file an application before the presiding officer at the mediation centre in your areas jurisdiction and tell them the whole issue file another Complaint before magistrate regarding threat and intimidation being committed by your wife n in-laws .

1. Do not give into threats.

2. If any complaint is lodged against you and it leads to registration of FIR then apply for anticipatory bail. Police cannot arrest without serving a notice to accused in 498A.

3. If a lawyer's notice has been served on you then it is imperative that you reply to it through your lawyer and deny the false allegations. It must always be replied.

1. You are free to file petition for dissolution of marriage on the ground of cruelty.

2. As I said before, apply for AB if FIR gets registered.

3. Maintenance claim by wife can be repelled by husband if he is able to prove that she is earning sufficiently on her own, but the mere fact that she is well qualified and was earning before marriage is not a ground to repel the claim.

You need to have proofs of her threats and that of her parents, next time if you have a chance to talk to them record them.

You can file police complaint against her and her parents for forcing you to leave your aged parents and live separately.

You can also mention about their illegal claim of 60 lakhs in the complaint.

Since she left your place, during next meeting try to record all their abuses and demands.

Most important thing is, you need to collect the WhatsApp chat messages from her phone.

You need to give exhaustive reply to the false notice sent by her and deny all the allegations made in the said notice.

You can mention about her attitude and her constant nagging for separate house and leaving your sick parents and demand of 60 lakhs etc.

Also highlight about messages being received by her and also about her flings (if you are sure)

If she is interested to join you at your matrimonial house, ask her to withdraw the notice sent by her in writing.

Immediately you install CCTV cameras at your place, so as to enable you to get proofs of their misdeeds.

It further help support your case.

No, wife is not entitled to claim property of Husband's parents.

Collate her previous employment details i.e., position held her her, salary draw, educational qualification, her ITR etc., which will help you to reduce alimony and  maintenance substantially.

1. You should collect the evidence of threatening by your wife and her family members for false cases against you. 

2. You should also record the behaviour of your wife with your parents and her demand for living separately or face legal actions.

3. After collecting these evidences leave your wife to her parents place and file divorce petition against her on ground of mental cruelty and demand of leaving parents.
