• Online IIM course demanding fee in Covid19

I have enrolled for a IIM online program in the beginning of 2020 I have paid first installment on time and second installment is due on May 30th 2020 that is 50 K. The service provider is TALENTEDGE since the beginning of Covid the kept several reminders and answered seeking time till August to pay second installment. Now they are threatening of removing my id and access. If I don't attend classes I will fall short of attendance. Please guide me how to go about it inorder to buy more time to pay second installment. I in hotels and no income source for last two months and don't know how many months in future with out pay!

You can express your inability to make payment due to lockdown 

 

request time of 2 months to make payment due to force majeure conditions

Negotiate with them for installment payment with interest. If required give undertaking. Or issue them post dated cheque. This is not a big issue and can be settled with all legal safeguards for both parties.

Well in absence of specific government directions on suspension or waiver of course fees many institutions are taking their regular fees or fees after a concession. 

Since you have an online course which doesn't require regular classes there is no scope for modification of fees nor they can be forced to give you further time for payment. 

In other words you have no remedy except to send them a request letter seeking further time which they its needless to mention are not bound to adhere to.

You can make  online complaint to HRD of central govt and write  all above situation. As of they are taking action against all the educational institution who are asking for fees and hike in fees.

You have not specified the University and state, in which, the same is situated. In Punjab & Haryana , the state govt have already issued instructions about fee, which matter is pending in High Court. The High Court has directed to collect 70% fee.In any case, you have to pay the fee.

This is an online program you had chosen hence there's no reason to postpone the online program.

There may be no exemption due to covid-19, at least legally. 

If the institute allows you the desired privilege using its discretionary powers  you can avail it, but you cannot claim it as your right.

- The central government’s regulatory body for technical education has issued advisory to all the educational institute , for not charge fee from the students until the nationwide Lockdown is lifted. 

- Hence, the service provider TALENTEDGE , cannot force and threaten you for deposit the fee during the lockdown , and by doing this , they are adopting an illegal path .

- Further, they cannot remove you id and access to attend the online classes.

- You can lodge your complaint against that provider before the education department , and also liable to take refund of the amount which you have deposited earlier.

Nobody will be suspended due to non payment of fees at present situation. Govt. Advisory. 

If they terminate you programme, you can obtain order from court to reactive your programe with compensation.

They are providing the services in lockdown so they can ask for the fee during lockdown as lockdown donot have any effect on online operations.

But as your business is down since two months than you can send them a legal notice against the termination of you ID. if still they do than file an temporary injunction application against the termination of your ID.

1. Send a representation to the institute to stat that you are unable to pay the fee due to lockdown and seek deferment till after withdrawal of lockdown and restoration of normalcy in every sphere of life. Lockdown is a force majeure.

2. If your representation is rejected and your name is struck off then a writ petition to challenge the termination can be filed in the High Court.

You communicate to them in writing your present position due to pandemic and lock down.

Seek extension of time by 2 or 3 months for payment due to lock down.

If the your service provider removes your ID and stops your access, you can lodge complaint to Ministry of  Higher Education against said IIM and also against service provider for not considering  your representation and dealing in a high handed manner.
