Now I am non agriculturist.. I am thinking to purchase 1 acres agriculture land in my native place..from 1974 to 1993 my father was having a agriculture land in his name..he sold out his property in 1993..he is expired in the year of 2014.. Now I.. On base of my father's documents.. Can I purchase the agriculture land. Please reply me

If your annual income is less than 25 lacs. You can buy land without any special status.
Father agriculturist status is suspend now.
If any govt guidelines order copy is there to purchase it on base of my father's documents..

The documents required to buy an agricultural land are-
1. Mother deed and the sale deed.
2.Akarbandi: Land topography sketch issued by State Revenue Authority viz. survey department. It establishes the survey number and to whom the particular survey number was originally allotted and the land / property revenue assessment details.
3.Encumbrance Certificate: Certificate from State Revenue Authority stating that there is no lien on the land / property (Has to be obtained for the last 30 years)
4.Family Tree of the vendor: State Revenue Authority document required to ascertain whether other family members have a stake in the property.
5.Saguvali Chit: It is also called Grant Certificate. This is issued on Form No..VII in case of grant of Govt. land to the eligible persons for cultivation. This establishes title of the persons in the Saguvali Chit to the land granted.
6. Conversion order.
7. Khata and up to date tax paid receipts.
8.Village Survey Map: Land location sketch
9. Patta Book: This book contains information regarding the payment of land revenue and other Govt. dues & information of cultivation. And also contains a copy of the record of rights to the land / property situated in Bangalore.
10. Tippani: This issued by the Survey Dept. It shows a sketch of the land as the records of the survey Dept.
Comprehensive Development Plan (CDP), Zonal Regulation Map and Survey Map. Apart from the above property should not come within the Green Belt Area.
By way of the 2015 amendment to the Act, “non-agriculturists”, or people whose families did not own any agricultural land in Karnataka before 1st April 1974, are allowed to acquire agricultural land provided their annual income did not exceed Rs 25 lakh per year. In addition, the power to transfer ownership of agricultural land has been provided to the Deputy Commissioner (Revenue) of the district.

Since your father was an agriculturist, you will also be treated as an agriculturist. Obtain RTC of the land showing his name in it. You can go ahead and buy the agricultural land.
- As per rule in Karnataka for purchasing agricultural land:-
- Since your father is already an agriculturist root , hence you can purchase agriculture land legally.
- Further if your income from all sources is less than 25 lakh then also even being a non-agriculturist also can applied and purchase agriculture land there.
- You should approach to concerned district Deputy Commissioner ‘s office , for getting agriculture family certificate and to apply for permission to buy land.
- But the permission is granted with a condition that you will cultivate the land for 5 years from the date of purchasing the land.

16. Endorsement from Assistant Commissioner that there is nothing pending under Karnataka SC & ST (Prohibition of Transfer of Certain Land) Act 1978. An endorsement from Competent Authority stating that the land is not a granted land.
17. Genealogical Tree – Family tree/Succession Certificate

Agricultural land can be bought in Karnataka after fulfilling certain requirements.

As per Section 79A of the Karnataka Land Reforms Act 1961, the non-agricultural income of a purchaser who must be an agriculturist should not exceed Rs 25 lakhs per year. Sale of land granted to members of scheduled caste and tribe is not allowed. Also, sale of land granted by the government is not allowed for a period of 15 years. Agricultural land can be used only for agricultural purposes and no other purposes. Utilising agricultural land for any other purpose is prohibited by law. Agricultural land, which does not come under the Green Belt, can be converted for non-agricultural purposes like residential, commercial, industrial etc, subject to the approval of the Special Deputy Commissioner on payment of the prescribed fees and subject to certain conditions.
