• Court reopening after Covid 19

I am very badly waiting for the courts to reopen as all my cases are pending for months together....My city is in green zone but still the courts are remaining closed....All government offices,shops ,etc are all opened by now ,but still the court remains closed.

I have my 498a,dvc case,divorce case and defamation case pending .....when will the courts reopen and when will the pending cases come for trial?
 
Some are telling for next 6 months it's going to be the same .......
Is it true ?
Is there anything I can do to start the trail of my cases through video conferencing???

1. There is no certainty also no date for normal functioning of court is announced so you have to wait till any such notification is there.

2. The trails are not being conducted through video conferencing only urgent matters of bail are taken.

3. See no fixed time is still announced you should wait for proper notification.

You have to wait for courts to reopen 

 

most probably court will open in June 2020 

 

cases will take time to come for trial 

 

there is no urgency in your case so video conferencing facilities may not be available for your case

1. Nobody knows when the courts will reopen.

2. At least in the next 2 months the normal functioning of the courts is not likely to resume at district level.

3. Only urgent cases are being heard through video conferencing, whereas your cases cannot be treated as urgent.

Hello,

  1. It is not going to take 6 months for the court to function normally. It can take another month or so looking at the current scenario. You need to brace for some changes in the way the courts are going to be functional in the future.
  2. You can certainly ask your lawyer to make a mention of your case to be taken up if there are issues that are urgently needing disposal. The court concerned will exercise its discretion on deciding to let you the hearing as currently, the matters of remands and bail are the only matters being considered. Wish you good luck.

Court will not reopen until further orders from concern High Court. If your city is in green zone than will open soon.  Most probably 1st June.

Wait till this 4th lock down.

Cases through video conferencing have started bit inly urgent cases are being heard. You have to show urgency. Some states have defined what would constitute an urgent case.

Domestic violence cases are designated as urgent cases in some states. Therefore ask your lawyer about the notification.

The situation may continue for 3 4 months.

The courts are not controlled by the district authorities  so that since your district is coming under green zone, the government will allow the court to start its normal functions.

High court of Madras is the competent authority to pass an order for all courts in the state of Tamilnadu and Pondicherry  in this regard.

All these cases are not of urgent category hence the court may not even entertain video conferencing trial of the cases.

Not only you, there are lakhs of litigants suffering during to the present pandemic crisis. 

All are waiting patiently, hence you too may wait.

Courts are going to resume atleast 35% legal matter very soon, however, for the complete rest,e\ption of work it may take another time span of 2-3 months as per the present scenario,

1. It the Policy decision of the Government to keep the courts and educational institutions closed till the lock down is fully lifted.

2. Now if you are in hurry you can consider filing a PIL in high court or supreme court so the courts are reopened once again to function like before.

3. Till then wait like thousands of the litigants till the government becomes wise and takes a decision to normalise the situation.

1. When the Courts of your area will reopen will  depend on the decision to be taken by the High Court of your State.

Its not at all true for next 6 months, but yes courts will only take up only urgent matters like Bail and Stay Orders till this lockdown is going on

- It is expected to start work from 23 May,2020 shift wise, i.e Criminal court in day time and civil cases in evening . 

- However, you can move an application for allowing urgent hearing of your cases through video conferencing .

- If, your cases will not treated as urgent one, then there is possibility that you may get a short date for hearing from the court.

Going by the  developments, working of high court through VC, the trial courts are likely to start functioning some time by end of June, 2020 / July, 2020.

You have to wait till the courts starts functioning fully, it is not your fault.

Six months to start functioning of courts, not sure, The courts cannot wait such long.  It is not authentic.

No, you cannot do anything, since your cases do not fall under Urgency Category, as such, VC is not available to you.
