• OBC Certificate of a married woman

What if a married woman whose father is no more, have applied obc certificate from Husband's side will it be valid for job requirements or she have to apply for father's side? As father is no more nor she have any documents of her father's available with her.

OBC certificate whether creamy or non creamy issue on the status of father only. 

Since father is no more , no income of father. She is entitle to non creamy OBC. 

For only caste certificate, she will requore document which prove parenthood. Apply for legal heir certificate of father.

If the husband belongs to OBC then she need not to apply from father's side ...else she need to apply from father's side ...and if husband in in OBC layer then is have right to apply for that and get the same ...no one case rase objection in it ...

1. See has to apply from father's side. If father is no more and mother has no income same can be mentioned in the form and it can be applied.

Death certificate of father can be obtained from local municipal office.

A woman whether married or unmarried, she is eligible for OBC NCL category privilege based on her father's status only even though he has expired.

If she is not having any documents then she my have to procure the same from the sources where it will be available.

This cannot be claimed as an excuse.

If she wants to avail the reservation concession provided by the government, she has to put her efforts  without which she cannot expect somebody to do it for her sake.

If the woman is married the woman's economic status is determined through the husband. The husband's earning is what determines whether the woman would come under the obc ncl category status.

- For getting OBC certificate , a  married woman  should apply from her  parental address. 

- There is no problem , if father has already expired, as for getting caste certificate , one has to show that his family belongs to OBC category, It means if the death of father , she can submit the caste certificate of her near relatives , and even no body is having the same , then a letter from the MLA/Mukhiya/ Pradhan etc with declaration that he knows that that woman is belong to OBC category is enough. 

- However, for getting OBC-NCL, her husbands income would be considered.

1. OBC NCL certificate is issued on the basis of status of parents, not spouse.

2. The certificate will not be valid if applied on the basis of husband's income or status.

To decide the OBC status of a person, it depends on the income of father of such person.

In your case, it will not help you since you filed from your Husband's side.

In case if you want to claim OBC, you need to file the application on the basis of your Father and not your Husband.

If you do not have documents of your father, you can approach his employer and make a request.
