1)refusing to have sex is ground for divorce as it amounts to mental cruelty .
2) if wife is virgin then you would be able to prove that marriage has not been consummated
It's not crime. It can be ground for divorce for aggrieved spouse.

yes you can file a divorce on this ground.
Marriage without sex is akin to a body without without blood. That marriage without sex is an anathema has been recognised by courts. You can apply for divorce on this ground.
