I’m a male, Hindu, 28, residing in bangalore for 10 days. My partner , Hindu, female, 26, is residing in bangalore for several years. We would like to know how to get a marriage certificate in bangalore and the procedure involved.

See you can both marry in temple or in small ceremonial marriage before Arya smaj and can get same registered with the Registrar of Marriage.

You need to file an application in prescribed format along with affidavit and identity proofs and signature of witness of marriage.

The registrar shall on same register the marriage.

If you want a court marriage if you are the domicile of Karnataka you need to fill up a form for intended marriage and after one month your marriage would be complete.

Have you both married  each other, if not first arrange for the marriage anywhere in Bangalore following the customary and religious rites, give an application with all the documents for registering your marriage before the jurisdictional marriage registrar in Bangalore, get it registered after complying with the further formalities.

As soon as you complete 30 days in Bangalore you can go for registration of your marriage as your wife is resident into that city registration is possible if you are already married on the same day of your application otherwise you have to apply for the registration of your marriage and the cooling period is 30 days after 30 days you can go to the registrar of marriages office and get a marriage registered if there is not different from any other related party

 Marriage can be registered at any place in the same state where you lived and you have the address for registration of marriage in any particular district which is not in your state you need to stay there for 30 days and any rental agreement with source your stay in that city for 30 days then you can go for registration in local registrar office please find out and advocate who may help you for your marriage registration.

Yes, you both should be present one month before registration of marriage in the same city and at same address for further verification that you both are living in the same city.

 

Give your both address proof that staying from last one month of application and till registration of marriage.

Sure, though you may have to get your marriage registered under the special marriage act

There is no specific form or essential ceremony for a marriage under SMA, but there are two possibilities:

  1. When you and your spouse do not want religious ceremonies: The parties can choose not to perform any religious ceremony and merely register their marriage before the Marriage Officer. You can decide how to perform the marriage but you and your spouse have to say the following to each other: ‘I, [your name] take thee [your spouse’s name] to be my lawful wife/husband.’ This has to be done in front of the Marriage Officer and three witnesses.
  2. When you and your spouse want religious ceremonies for your wedding: You can perform any religious ceremony (according to the personal law) and then register your marriage under the Special Marriage Act – There is one conditionthat you and your spouse should have been living as husband and wife from the date of the ceremony till date of registration.

What are the notice requirements if I am getting married under this law?

Step 1: You and your spouse must give a notice to the Marriage Officer of the district in which at least one of the parties has stayed, for at least 30 days before the date of giving notice. The notice should be in specified Form and state your intention to marry under the Special Marriage Act.

Step 2: The Marriage Officer will publish a copy of this notice and invite objection that the parties have not satisfied the requirements regarding capacity of parties explained above.

Step 3: After 30 days of publishing this notice and if there are no objections, the parties can get married under the SMA.

Do I have to give an advance notice even I am getting married with religious ceremonies and then getting registered under the Special Marriage Act?

You do not have to give advance notice if you have already performed valid religious ceremonies. However, once you make your application to the Marriage Officer, she will then publish a notice inviting objections for 30 days. If there are no problems, she will go on to issue a marriage certificate.

Either of party have a pre stay of one month before apply for court marriage. Will prove through Rent agreement.

Age proof , i`d proof will be of permanent address. It should be of Bangalore, no such compulsion.

You have not answered that whether you both are married or not?

First you get married and then with the help of the address proof documentary evidence you may apply for registration of marriage, dont worry about her different address.

The rental agreement is also a valid address proof.

- To register your marriage under the Hindu Marriage Act, both you and your spouse need to be recognised Hindus.

- The registration is done after the solemnization of the marriage , and it is not necessary to perfom your ritual marriage before the Registrar. 

- Firstly you need to apply to the sub-registrar under whose area of jurisdiction the marriage was solemnized,  Or, you could apply to the registrar of the place where either you or your spouse has been a resident of, for at least 6 months before the marriage. 

- You will have to provide a certificate from the priest who solemnized your marriage as proof that you are actually married.

- Witnesses of the marriage must acompany you to the registrar and they will be asked to show their proof of identity, such as a PAN card, and an address proof such as a driving license.

- Photocopies of all your documents must be attested , and to complete the registration, you need to deposit a nominal fee of Rs. 100 with a cashier. The receipt should be attached along with the application form.

- You will be assigned a date for the registration of the marriage after the submission of the application and the verification of the documents. The Marriage Certificate will be issued on that day.

Documents Required :-

1. Application form fully filled up and duly signed by the husband and wife.

2. Attested photocopy of Proof of Address, which could be a Voter ID, Aadhar Card, Ration Card, Passport or Driving License OR even a Rent agreement .

3. Attested photocopy of the any valid certificate showing Date of Birth.

4. Two recent passport sized photographs, and one marriage photograph.

5. A special marriage affidavit in the correct format by both husband and wife.

6. Marriage invitation card/ proof , just like certificate from the priest of the temple

1. You may marry under Special Marriage Act before the marriage registrar. 

2. The application has to be filed supported by an affidavit and two witnesses each. 

3. The notice of intended marriage will be published by the registrar on the notice board to invite objections and he will fix date after a month.

4. If no objections are received within a month then a civil ceremony can take place.

You can provide rent deed of current address for registration of marriage.

If you both are Hindus then first you should marry and then go to the registrar office wherwin a deputy registrar will register the marriage. Aadhar card and photos would be sufficient.

You need to apply the same in sub registrar office with required age proof and address proof along with marriage documents. You can rely on rental agreement only if it's registered. Other wise society letter is also valid
