When criminal case is pending, it is law that only short validity PP will only issue which is for one year.

It can be extent but not for 5 years.

Due to pending criminal case against you passport would be issued to you for period of one year only 

- As per the circular dated 21.08.2014 issued by CPV Division of Ministry of External Affairs (MEA) you will have to give an undertaking while applying for the Passport , in case any criminal case is pending . 

- Court order as per GSR 570 (E) dated 25 August, 1993. ke anusar , agar koyi case chal raha hai to , kewal 1 year ka passport issue ho sakta hai. 

- Agar apko 1 sal ki validity ke sath passport issue ho chuka hai to koyi problem nahi hai ,India se baher jane me , and jis mulk me ja rahe ho, wahan se bhi renewal age kara sakte ho aasani se.

Yes, even when a person has a criminal case be it or any other pending against him, he can get a passport. For that two formalities have to be completed. A. The permission from the court as required under GSR70 dated 28.08.1993.

Yes. One can certainly apply for passport, bit one should disclose the fact that criminal proceeding is pending against him. Nothing should be concealed, or else your application for passport may be rejected.

And when you get the passport, you have to inform the court as well. The court must have imposed the condition in bail order that of you hold or have the passport, ot should be deposited with the court. And if you would like to live the country, you should get the permission from the court.

There is a notification of Government that even for applying the passport, the direction has to be obtained from court and based on that order only that the passport authority would issue the passport.

You can apply for a re-issue of passport up to 1 year before the expiry or within three years after the expiry of the existing passport without fresh police verification, provided there is no change in personal particulars and there is clear police report with respect to your previous passport 

You can not renew the passport more than one year before the expiration date of your current passport. When a new passport is issued, old passport(s) will be cancelled and returned to the applicant. Valid visas in the old passport are not cancelled and can be used till the expiration date of a given visa.

You have to file a petition before the concerned judicial magistrate  seeking issuance of passport for the desired number of years, it is the discretion of the magistrate to pass an order, however the magistrate may not pass an order of validity of passport for more than a year.

1. You should be happy that you have got the passport in the first place even if it is for a shorter duration.

2. Most people who have a criminal case pending against them do not get the passport in the first place.

As per the passport act, if any criminal case is pending against anyone he can get only a Short Validity Passport. Short Validity Passport is valid for maximum One year and has to be renewed every year till court cases last.
