It is probable that the property was constructed in the year 1980 and probably they had an municipal approved plan. 

It is also probable that any irregularities in construction might have been regularised, given that the building is 39 years old. 

However you can still check with Town planning office of brihanmumbai municipal corporation to find out whether there are any pending cases against society pertaining to violations in building construction. 

Also you may check property tax assessment receipts to see whether the society is paying any penalties for deviation/violation etc.

You want CC or OC for the flat constructed  prior to 1980?

What is the necessity for CC or OC at this stage for the building which four decades old, in fact your flat may also be eligible for redevelopment at this stage, hence you can be clear in your question or the clarification you want from here in this connection.

It is not applicable on such old buildings now you cannot obtain for these buildings. 

Both are valid until no new construction after demolition of old structure.

OC CC not required on such old building. 

Society is Right as it is an old building which was constructed about 40 years back doesn't need OC and CC.

So it will not be applicable on your building.

file a RTI Application with the BMC to provide certified copy of sanctioned building plans and CC and OC for this building, if any issued

MOFA came into force in 1963. So atleast from that year OC/CC are appliacable

for very old constructions even prior to 1963, the BMC would have the records

This is my response to you:

1. It is acceptable;

2. How come the society can reject it, if the CC and OC remains same for the building;

3. You can send them a legal notice;

4. If they harass you further then you can file a complaint to the registrar or co-operative court;

5. Consult a local lawyer and take steps.
