• Change in DOB in passport

I want to change DOB in my passport. my passport has DOB 15/05/1954 as per school leaving, but as per my birth certificate it is 15/04/1954. My first passport was issued during 2007 and second issued in 2017. but now i want to change my DOB in passport.

You can apply the same with affidavit and you need to submit the correct documents for correct date

Approach the Passport Issuing Auth., with a request to update your DOB on the strength of your birth certificate.

Passport issuing authorities (PIAs) are authorised to consider request of each applicant seeking change in date of birth. In case your request is not entertained, approach the High Court and file a writ of mandamus.

See based on birth certificate you can file an application before RPO to rectify the passport as there is notification that based on birth certificate the passport can be changed.

Dear Sir,

An application for re-issue of passport in respect of change in personal particulars will have to be submitted for change in DOB.

But if you are holding current passport with validity and you are applying for changes in DOB than you will be fine a penalty of 5000.00 Rupees for it because you presented wrong showing DOB documents during previous passport issuance. If you have emergency than you can apply now but your application might stuck at RPO and they will cross-verify all DOB documents (Birth certificate/school leaving certificate) and send them to place of issue too. So it may take time up to 6 months approximately.

I advised you to wait till your passport expiry than you can apply for re-issue and also submitted for changes in DOB. If you follow this procedure than skip above steps and will get passport in normal time period.

2) you can rely upon birth certificate which reflects  your actual date of birth 

 

3) however issue is what were you doing for 12 years 

 

4) the delay of 12 years would prove fatal and passport office may not agree to change your date of birth in passport 

 

5) you can then file writ in HC to direct passport office to change date of birth in your passport but chances of success are bleak

- Earlier the ministry of external affairs have served orders to the passport issuance authority not entertain or accept any request for the change/correction with regard to DOB, if the period of issuance of passport has exceeded five years.

- Now, ministry has issued notification that bonafide claims for change or correction of the date of birth will be accepted.

- Hence, now you can apply for a change in date of birth in the passport at any time after the passport has been issued.

- If the error was from passport authority, then a new passport is issued with correct date of birth without any fee. - - If the error was from applicant then they charge a fee of Rs. 500 for issuing a new passport with corrected date of birth.

Documents Required

1. Birth Certificate issued by a municipal authority or district office of the Registrar of Births & Deaths

2. Date of Birth certificate from the school last attended by the applicant or any other recognized educational 

    institution

3. An affidavit sworn before a Magistrate/Notary stating date of birth by illiterate or semi-illiterate applicants.

- Dont worry you are eligilbe for re-issue of passport after correcting the DOB as per your wish.

You can apply for corrections in the passport for to change DOB as per birth certificate, but now you have to give valid reason...

1. You ought to have initiated the process of rectifying the error when the passport was issued in the first place.

2. If the date on school leaving certificate matches with the date of birth mentioned on the passport then RPO will not change the date.

3. You will have to seek orders from the court.

4. Apply for rectification of DOB on passport by annexing the copy of birth certificate. If the rectification is not done then you may file a writ petition in the High Court to seek appropriate orders.
