• Issue with marriage certificate

Hi

My name and my wifes name in marriage certificate issued at nagpur are not matching with our respective passport names. For US visa, the passport names and the marriage certificate name should match exactly. Our passports have spouse names mentioned correctly. 
How can i get the name changed in marriage certificate, please advise?

Dear Sir,

Apply for a new passport along with the old passport, marriage certificate, copy of husband's passport, and other details to change the name in the passport. ... Attach the affidavit or the marriage certificate as a supporting document to prove the reason for your name change.

File an application before the marriage registrar for correction in the certificate, the magistrate may issue another marriage certificate with correct address. 1. you should file a rectification application along with requisite document.

Marriage certificate reflects same name you filled in form and enclosed I`d proof. Had to be care full at that time. Which name is reflecting in other documents ? which carries in passport or MC ?

Else have to obtain direction from High Court ?

Is it a court/inter caste marriage or conventional marriage ?

File an application for correction /rectification before the registrar of marriage he shall correct the certificate. 

In case they deny you need to.file petition before high court for direction.

You can provide your an application before the Registrar of marriages where the marriage was registered .

 

One fills a file in which one discloses all information of the marriage. You should see whether the error is on your application or the error is attributed to the Registrar office.

 

In case the error is on part of Registrar then the Registrar should correct the same.

 

In case your fault then move the application for correction and after satisfaction the Registrar ought to correct the mistake.

-  Legally , you have right to change your name in the marriage certificate. 

- Do the needful as given below for changing your names in the marriage certificate 

1.Execute an Affidavit on Rs.10/- stamp paper with your details and your wish to change your name now that you are married.

- You should mention the details like your maiden name, proposed new name, husband’s name/wife name , your address and a copy of your marriage certificate.

2. Notrised the said affidavit from notary public.

3. Publish in two leading newspaper of your city an add for changing name. 

4. Submit a written application with a copy of the marriage certificate and address proof to the Gazette department requesting name change due to marriage.

5. Finally submit all the above mentioned document with the Registrar for changing the same . Within a short period of submission , you both will get name changed in the marriage certificate.

Your marriage certificate has been issued by the register only and the taste of document that you provided at the time of your marriage is has nothing to do with your passport in case there is any mismatch the passport and the marriage certificate then you have to approach to marriage register for correction please tenure documents in case it is not possible by the registered to change your marriage certificate then you have to find a civil suit in this regard for correction of your marriage certificate and on the basis of the order of the court then the  registrar will affect the changes and issue duplicate certificate

You have to file suit for mandatory injunction to change the names on marriage certificate because registrar of marriage will not allow the change of name in marriage certificate without order from court.
