• Extension of sale agreement

I have entered in sale agreement for buying a flat with seller. Property is mortgaged by seller and seller is unable to clear the balance loan amt and registration is going delay. Two time already agreement extended.
How many times we can extend the sale agreement as per legal validity

AS much time by mutual consent otherwise on failure to register the sale deed by seller, you can rescind the agreement and demand refund with interest.  .

Dear Sir,

There is no such limitation in respect of number of extensions but such number shall be reasonable and every extension gives extended period of 3 years limitation from the date of extension. It is better to stop such extension and ask for specific performance by issuing a legal notice .

- As per law , the Sale agreement is valid for three years.

- But, if there is given any clause of fixation of time limit , then the limitation will be extended by such period.

- Check your sale agreement for the time limitaion of executing the sale deed.

There is no bar to extend the Agreement of Sale any number of times, if it's mutually agreed by both seller and the buyer.

1.  Extending the Sale Agreement is possible endlessly till actual Sale Deed is registered.  There is no such limitation and is dependent on the clauses of the Sale Agreement between the parties.  This is however not advisable.

2. The Buyer party can clear the Seller's Loan liabilities  .OR. transfer the loan liability to the Buyer, subject to incorporating the relevant clauses in the Sale Agreement and NOC of the lending bank.

3.  AFTER above, Sale Deed MUST be immediately registered and possession taken over, without any delay.

normally limitation period regarding sale agreement is three years from the date mentioned in the agreement condition. but you are in safe stand you may give legal notice and accordingly to do so.

The sale agreement is valid for three years from the last date of extension of sale agreement. 

It is up to you to extend the same any further or to cancel the same.
