Hi 

I got married to man from Punjab two months ago. 
He came to UK to visit me two weeks ago but has run off with the marriage certificate papers.

I am scared he will now annul marriage illegally in Punjab by bribe.

Also how can I get copy of my marriage certificate? And what is process for divorce?

Apply to registrar of marriage where marriage was solemnised for copy of marriage certificate 

 

2) second marriage during subsistence of earlier marriage is illegal 

 

3) you can file for divorce only on expiry of one year of marriage in India 

 

4) you must be having marriage photographs, invitation card to prove your marriage 

 

5) you can file for anullment of marriage within period of one year of marriage on grounds of fraud

RTI means Right To Information under this act you will be able to get the marriage certificate in duplicate from marriage registrar.

 

And for annulment of marriage he has apply in the court properly and you will be also present in the court.

 

Within one year you can go for annulment instead of divorce. Because in future you will be not called as divorcee as well.

Apply to registrar of marriage for issuing a certified copy of the marriage certificate. You will get it. 

Your husband can do nothing with this certificate alone.  Annulment is possible only in certain circumstances.

You can file divorce petition in the court of your present country for some valid ground. Foreign court decree is valid in India.

1. You can get certified/duplicate copy of the marriage certificate only from the office where the marriage was registered and from no where else.

2. if you have photocopy then on its basis also you can apply for divorce.

3. If you do not have photocopy then get in touch with the Marriage registrar who can hep you to get its duplicate copy.

You can file a police complaint about the same in uk and Punjab. You can get the copy from marriage sub registrar. For divorce you need to apply in India or US depending on your preference. You can apply mutual consent or contested divorce

- RTI (Right to Information), This is the act which was brought by the govt to have information on govt activity. However, it will not help you to obtain the marriage certificate.

- First of all you must file the complaint with local police on lost of documents immediately and later once you have the registered complaint copy, do connect with local authority in India with same 

- Any of your family members can obtain the marriage certificate on your behalf.

See you can file an application before the registrar of marriage where your marriage is registered to get the certified copy of certificate. Or alternatively can file RTI application.

Further you can file complaint against him in UK. Also for divorce you can apply before court on ground of cruelty in India. If it is before one year of marriage you need to take permission from.court.

Marriage cannot be annulled by way of paying a bribe.

You can obtain certified copies of the marriage certificate from the registrar office where it was registered after payment of requisite Fee.

In order to get divorce, you have to file a petition for divorce in family court which can either be contested or mutual consent divorce.

The marriage was solemnnised in india and he went back to India. He cannot file for annulment without stating reasons and you would be issued notices by the court first.

Also a marriage certificate can be obtained again from where your marriage was solemnised. An application on your behalf would have to be given.

- Marriage certificate papers are not enough proof for annulment of marriage.

- No one get annulment after giving bribe.

- That man has taken the Marriage certificate papers from you , to destroy the proof of marriage.

- If, you are not having any othe proof with you , then you can face problem and he may be successeed in his goal .

- Photograph of marriage is also an evidence for the marriage.

- You can get the certified copy of the said marriage certificate papers from the Registrar office ,under whose jurisdiction , the marriage was performed. 

- Better to engage a local person , to get the copy of the same.

- Divorce order can be taken after filing mutually.

- Otherwise, one has to file Petition for Divorce before the Court for getting divorce as per law.

3. Was there any religious ceremony performed during your said marriage for which you have the evidence.

 

4. You can collect certified copy or duplicate copy of the said marriage certificate from the same Marriage Registrar.

 

5. Marriage can not be annuloed or decree of divorce can not be obtained by just producing the marriage certificate. 

6. For getting the marriage annuled or getting the decree of divorce, your husband shall have to file appropriate applications with accepted grounds for which you will be served with copies of the same and shall be asked to0 submit your WQritten Objection.

 

7. You shall get ample chance to defend your self against any such application, if fild by your husband in India.

1. RTI is an Act .e. Right to Information Act. Based on it one can ask for information from any Govt. Authority. RTI is not applicable in the binstant case sinbce you do not want information which you already have. 

 

2. What you want is the copy of the marriage certificate which you can collect by following the steps as advised in my earlier posts.

 

3. If you have the date of your marriage registratyion and the name and address of the Regiatrar, then you can avail copy of the certificate by taking the suggested steps.

You can apply for copy of marriage certificate from marriage registrar office in Punjab by sending someone from your family with authority letter from you. 

He cannot annul the marriage without any information to you because court issues notice to respondent whenever there is any case filed against them.

If your marriage had taken place i India then you can apply for duplicate copy of the marriage certificate from the marriage registrar's office.

If you want to file divorce case in India, then you can contact an advocate in India at your place  and file a divorce case on the advice and assistance of your advocate.
