Regards
once police file B report you can file protest petition against final report that the police alongwith collusion of the accused persons submitted the final report without recording the statement and without collecting the evidence in arbitrary manner.
2)
Magistrate may accept the final report and drop the proceedings after hearing the complainant/first informant.
3) . He may dis-agree with the conclusion arrived by the police officer and straightway may take cognizance in exercise of the power under Section 190 1 (B).
4) . He may order for further investigation
Dear Sir,
You have to file protest Memo before the Court and get it converted into private complaint.
You can challenge the same in writ petition or if loyakuta is a activated in your state then before lokayukta
1. It is not clear whether the Police has closed the case or not by filing B report.
2. if yes then then you being the complainant has the option of filing a Protest petition so that the court may send it for re investigation or treat the case as complain case.
3. At the time of hearing of the Protest Petition you can place all the materials you have in support of your allegations.
4. if your Protest Petition is not allowed then you can file Revision case high court.
Magistrate is no competent to order Re-Investigation into the matter. As per the powers provided to a Magistrate, he is either to accept or reject the cancellation report submitted by the Police. if he accepts the Cancellation Report then the matter comes to an end there....but it has not been accepted then the Magistrate can himself take cognizance of the matter and put it for evidence as per the procedure prescribed. you must definitely challenge the said order before the appropriate court and under the guidance of your local lawyer.
File protest report against false report, court will take cognizance. OR file writ in HC for change of investigation officer.
Hello,

If the police has filed false FIR against you approach the High court under Sec 482 CrPC seeking quashing of FIR against you also if you are appearing in court file an application seeking discharge from the case.
Dear
The court will summon you on the next date of hearing before disposal of the case on false B report.
You should appear in the court and give statement regarding dissatisfaction over the report submitted by police and ask permission to file protest petition in the case.
File protest petition and contest your case in court.
If the police is filing the B report before the trial court, the trial court will notify the defacto complainant about this and would seek his objections, if any, to close the case. you can file your objections to this based on all the evidences whatever you had submitted before police and seek re-investigation of the case by another IO under section 173(8) cr.p.c.
