• How to get fist class magistrate affidavit

Hi
I have been asked to give an affidavit of birth from a first-class magistrate. Can someone let me know how to get it done? Who is a first-class magistrate?
[I will get help from local advocate but wanted to figure out what all may be needed before I go there]

A judicial magistrate is under the general control of the Sessions Judge and is subordinate to the Chief Judicial Magistrate. The First Class Magistrate decide criminal cases, which are punishable with imprisonment for a term not exceeding three years, or with fine not exceeding five thousand rupees or of both.

Among executives, the District Collector, ADM and Sub-Collector weild First Class Magisterial powers as they deal law and order issues. First Class Magistrate in India is a Judicial Officer under the Judicial Hierarchy of India.

1.  That the exact and correct date of Birth of my son/daughter _________ is_________ who born at _________.

2. That the deponent was born in _________ Hospital, _________ on _________ and the birth event of the deponent was recorded in the said Hospital on the same vide Serial No. _________.

3. That the name of the mother of may above said son/daughter is_________.

4. That due to inadvertence, I did not register the date of birth of my above said daughter/son _________ with the concerned department at the time of birth.

You can get an affidavit from the notary magistrate it is valid. A affidavit can be drafted and notarized it will be valid.

You can execute an affidavit in this case.  If the clause is only through first class magistrate then it has to be affirmed by him.

2) if Registration has not been done within one year; the registration can be made any time by submitting the affidavit before first class magistrate or executive magistrate. The magistrate verifies the details of affidavit and if found satisfactory, issues the order to Registrar to enter the entries of birth in birth register
