• Change of DOB in passport

Hello sir,
I recently had applied for reissue of my passport. I am a major now .When I went to PSK they opened my old passport file in which my Dob and place of birth are different .They told me to go RPO .RPO officer suggested me to cancel my new Dob and they will reissue my passport on old Dob. But my all recent documents are having new Dob including pancard,aadhar card,voter id, driving licence and marksheet of class 10. Please suggest me that how can I make passport on my new Dob.

Dear Client 

If passport office  is refusing to insert your DOB which is mentioned in all your certificates then you should get the orders from court for changing the DOB in passport as you are major now.

For that you have to file suit for mandatory injunction in civil court having jurisdiction 

The suit should be against the RPO and issuing authority passport.

You need to get the DOB corrected on your passport on the strength of your High School marksheet and your birth certificate.

Thus, as advised approach the Competent Authority seeking the above correction on the strength of the highlighted documents.

Dob can be changed if you were a minor when the incorrect dob was written a genuine birth certificate shall be required along with fine.

See you can furnish your birth certificate for modification of your passport DOB as it is strict proof of same. 

If they fail to change dob then a writ petition before hc for direction can be filed.

You can file an affidavit with the authentic document showing your correct date of birth.  The passport office will rectify the same in their records and reissue fresh passport

1. Get an affidavit executed befo0re the 1st class Judicial Magistrate of your area affirming that your DOB and place of birth was wrongly mentioned by your guardian/father while applying for your passport when you were a minor which is required to be corrected now and your passport is requirede to be reissued with your actual DOB and place of borth.

 

2. With this affidavit you can apply for reissue of your passport with amended DOB and place of birth.

 

3. The passport office will rreissue your passport with amended date and place of birth based on the said affidavit.

you would need court orders to change your date of birth in your Passport. 

A court order issued by a judicial officer not below the rank of 1st Class Magistrate in India Also called Declaratory Order.

Since you were a minor at the time of issuance of the old passport and now you are a major therefore you may file a suit and there are high chances that you will get a favourable order.

Dear Sir,

An application for re-issue of passport in respect of change in personal particulars will have to be submitted for change in DOB.

But if you are holding current passport with validity and you are applying for changes in DOB than you will be fine a penalty of 5000.00 Rupees for it because you presented wrong showing DOB documents during previous passport issuance. If you have emergency than you can apply now but your application might stuck at RPO and they will cross-verify all DOB documents (Birth certificate/school leaving certificate) and send them to place of issue too. So it may take time up to 6 months approximately.

I advised you to wait till your passport expiry than you can apply for re-issue and also submitted for changes in DOB. If you follow this procedure than skip above steps and will get passport in normal time period.

If nothing works in your favour, approach the High Court by way of filing a writ of mandamus against the Passport Officer and seek a direction in your matter from the High Court.

For reissue of the new passport they charge Rs.500/- for correction of DOB if the fault lies with the applicant if fault lies with them they can't so first see it , then apply to the RPO  with proof of correct DOB (SSC Certificate).
