• Occupancy Certificate for new Flat in PCMC Pune

Hello Team,

I am buying a new flat in Ravet,PCMC area. i have checked all the dosuments and found OK.
CC is yet to come but when i asked about OC (Occupancy certificate) for builder he doesnt know anything.
s it mandatory to have occupany certificate before buying a flat in pune PCMC area.
It falls under pune municiple corporation..
i have aksed many but they dont know.. they only have Completion Certificate and Possession letter

1. Occupation Certificate (OC) is issued after the construction meets the building standards. A CC alone cannot legalise occupation; you must have the OC too.

Without a valid OC, your occupancy is illegal as it can be classified as an unauthorised structure by the authorities.

2. OC is crucial while applying for a home loan or loan to purchase a resale flat. You cannot even sell your property without a valid OC in hand.

3. Key amenities like water, sewage connection, electric supply, etc, can be disconnected in case you do not have an OC.

So decide accordingly.

OC is mandatory for builder to deliver possession of flat 

 

if builder has completion certificate it should suffice 

you can purchase the flat

Purpose of CC is limited like distance from the road, the height of the building, and rainwater harvesting system but OC certifies that the construction of the building has complied with the approved plans. IF No OC issued mean construction not approved by local municipal authorities.

IT is mandatory for every residential complex, which is larger than five units and illegal to move into a flat or house without receiving the OC.

1. completion certificate is issued by builder's architect to the municipal corporation

2. thereafter the municipality inspects the building and issues OC

3. If building is under PCMC, then DC rules apply as per which OC is mandatory before giving possession

Hello, 

If the completion certificate is there then you may go ahead and purchase the flat. 

OC is also required and you may ask the municipal corporation about the same.

it is the builder job, but for your satisfaction you may enquire about the same from the Municipal Corporation. 

They will not give the same to you, but they will inform you about the status of the same.

1.  Occupancy Certificate (OC) is issued by Municipal Corporation, ONLY "IF" the building is constructed as per sanctioned plans.  OC is issued ONLY "IF" there is no violation.  IF OC is not yet issued, THEN it means that builder has violated the sanctioned plans.

2.  OC is issued ONLY to builder's Registered Architect and not to the flat-purchaser.

3.  You alone can also file grievance petition before the local consumer court, against the builder, for negligence & deficiency & harassment and claim damages and compensation for not getting OC.

Some places builders are contended with the CC itself. 

You may insist on OC, if there's no response then you may approach competent authority and make an enquiry about it  to proceed on this matter.

  1. As per the information mentioned in the present query, makes it clear that C.C. and PL is available but not the occupancy certificate.
  2. I would like to inform you that this document is also very important to showing your title as well as the possession over the property.
  3. So, would suggest you to please go and take the same from the Municipal Corporation office. You may not be needed physical presence of the builder but his NOC only.

Dear Client

The occupancy Certificate (OC)  is mandatory before purchasing the property but Completion certificate from MC can be enough for purchase of flat and you can go ahead with the purchase.
