• Receiving promotion calls since a year even after requesting to be updated under "Do not Call"

Hi Team., 

I have been receiving calls from different call centers promoting personal loans and credit cards through HDFC and ICICI . I have requested them infinite times to not call me, however i still receive calls. I perform night shifts and because of these calls i have not slept properly for a year now. 

Need your advice on raising a legal complaint against these companies (ICICI and HDFC) as they are not providing a solution.

You can make online complaint in consumer forum.  And send complaint email to RBI as well.

1. Making unsolicited phone call s no crime and hence there is no legal remedy against it.

2. However you have right not to pick up those calls or block those calls.

3. In any event you can not lodge complaint with any pubic authority.

4. Put an app in your mobile handset which would provide information about the the source of calls so you can decide not to pick those ones.

Hello, 

You may send a legal notice to them and ask them to refrain from doing the same. 

At times it happens that you call people and give them the right to share your number further. 

If this is the case then it will be difficult to do the same. 

Still you may try and send them a legal notice.

There are options suggested by telecom companies to block such calls or to report to certain toll free numbers abut such menaces.

You know such numbers based on their repetition, why dont you block those numbers instead of feeling so much about them.

Alternately you obtain the particulars of such unwanted callers and issue a legal notice to one or two companies.

After that you can even plan to drag them to consumer forum.

For a filing a complaint against a bank you first need to know the right process.

 

The main object of the complaint is to get resolved your problem as earliest. So it is most important to make complaint to appropriate person who will resolve your problem effectively. There is a system in Indian banking to get your problem resolved by contacting authorities in procedure. First approach to concerned bank, then Director of Public Grievances, Govt of India, then Ombudsman (RBI) and finally consumer forum. If you will follow the procedure you will find result sure.

 

Presently RBI (Reserve Bank of India) has compelled banks to hear customer on priority basis. On direction of RBI every bank has to appoint nodal office for redressal of customer grievances. Every bank has designated higher level office at head offices and other senior level officer at controlling offices and at large branches.

 

Steps of complaints

Write or e-mail to concerned bank branch, office or department Write or e-mail to nodal officer at controlling office and head office of the bank Write or e-mail to Director of Public Grievances, Govt of India, Cabinet Secretariat, Sansad Marg, New Delhi-110001 Complaint in appropriate form (along with copies of earlier correspondence with concerned bank) to Banking Ombudsman (Located at state capitals under RBI Ombudsman Scheme) District Consumer Forum (under Consumer Protection Act, 1985) complain in appropriate form. In this article we will learn more about banking ombudsman, their role, appointment & tenure, grounds of complaints among others. Banking ombudsman is a quasi-judicial authority created by Government of India to provide effective complaints resolutions. It is a senior official appointed by RBI to address the complaints by the banking customers. Some people also call it ombudsman banking.

Issue legal notice to companies that inspite of repeated request not to call you calls are received by you although you are registered under do not call

Dear Client,

TRAI has introduced reporting of these unwanted SMS and calls to 1909, the official TRAI number of DND, which is a very good initiative. A person can call on 1909 to register complaint or a SMS can be sent to 1909.
