Dear Sir, Before Registration of society,one flat member not paid any maintenance charges to builder(possessed flat in Nov-2016). After registration of Society in Aug 2018 Builder paid balance amount of collected maintenance. but still maintenance of that one member is pending. Society took charge now, before it builder was authorize to collect the maintenance and due to builder only. When builder surrendered the authority and collected maintenance along with books of accounts in which flat owner/s MC are showing due than recoverable by society.
Since the society is formed, it can take over the duties without any hesitation.

1. on and from the date of taking possession, the flat owner becomes liable to pay maintenance
2. the maintenance not paid by the flat owner results in greater liability for the other owners who paid their maintenance
3. since all flat owners have now constituted into a society, the society can also pursue pending maintenance from the owner who did not pay maintenance to the builder

You can file a recovery suit in civil court for recovery of balance maintenance charges but for that you should have complete records of maintenance registers through which you can prove that they did not payed the maintenance for which period.
