• Resignation after EOL

I am IRSE 2014 batch Group A officer in Indian Railways. I joined my service on December 2015 and my probation period ended in February 2019. From February 2019, i have been confirmed in service and my probation period is complete. I have secured admission IIM Bangalore for 2 year MBA program in 2019-21 batch. I have applied for Extraordinary leave (EOL) for the same. If I resign from my job after completion of EOL in 2021, will I be charged any bond amount?

Hello, 

this will largely depend on the service rule under which your appointment has been made. If the bond was valid till the period of probation only then the same can not be used now.

As per the relevant leave rules the employee is generally required to sign a bond for a period of three year and if the department has granted the leave without any bond and there is no relevant clause in the service rule then you ay leave the job.

Resignation will only mean that you would bot be entitled to benefits and pension etc. Youbhave completed your probation period and hence no bond exists as of now.

Extra ordinary leave has been granted to you post confirmation and while in service. Therefore you are free to resign.

Have you signed any employment bond with your employer at the time of joining the job?

If so you may look into the conditions of the same.

No doubt the employment bonds are not legally maintainable however you may have to struggle to prove that it is not maintainable by filing cases in CAT or before high court.

If you are sure that the employment bond what you have signed is valid only till the probation period, then you need not be worried about its effectiveness beyond the probation period.

Since your EOL has been sanctioned, you may first avail the leave and then think about it at the time expiration of the leave.

Dear Sir,

The law on service bond is subject to scrutiny by Civil Court. If you resign they may ask for entire bond amount but they have to approach the Civil Court if you resist. If your employer approach a Civil Court as per the settled law of the land only reasonable amount that to spent on your actual training will be given to the employer with installment facility to you.
