• Harassment from bank manager as refused to pay bribe

Dear sir/ mam
long back when my father expired we took education loan in my sister name for her studies , my mother was co borrower and i was gaurantor ,
now we are in gurgaon since three to four years my wife is having cancer , my sister is married but not working ,
i have been in talks with manager bank in rajasthan that i shall pay in installments also have pleaded them to wave off interest , 
now bank manger has asked for a bribe of 50 k , as loan amount was 3.5 lakh now with interest 6.5 lakh to get it done on my terms , inspite i have asked him to give pdc and shall pay him in instalment , 
account is npa,
now manager has started harassing my sister by sending notice to her husband work place , started humiliating us , 
please advice what to do ..........

You can complaint to anti corruption bureau and lead a trap.

Since your sister is borrower of loan in case of failure to repay loan bank can issue legal notice to borrower to repay loan

Don`t pay anything, account has been declared NPA and interest has been stopped. Mail to his higher authorities about asking bribe.

Notice cannot be send on her husband, invalid service. You don`t him any cheque. Later bank will offer one time settlement. Till than avoid them. Nothing will happen.

1. Do not pay any bribe as this would make no good to you.

2. Rather send them a scheme for repayment.

3. if they refuse then they can nevertheless file a case to recover it but the same would take a long time as the loan is an unsecured loan.

4. So in course of recovery of loan you can arrange money and again negotiate for its settlement by making a lump sum payment of money.

- Since, the said loan was sanctioned in favour of your sister and you was gurantor , then as per law , the bank manager having no right to send any notice to your sisters husband.

- As, the account is aleady NPA , then the bank will file case for recovery of the loan amount , where you will get chance from the Court to settle the amount with the bank.

- Better, you should lodged your complaint after narrating all the facts , including your family financial situation to the RBI Omudsman and to the head office of the said bank.

- Sure, your problem will be resolved , as your case is looking genuine .

You are suggested to file complaints of corruption bribe against that manager to concerned agency i.e. bank, police and vigilance for asking bribe. At the same time, prepare yourself  for repayment of loan.

Dear client 

You should write a formal letter for application of loan waver and making Installement of rest of the amount to manager and also send the copies to regional manager of bank and senior manager of that bank also in reply to the notice he has send you and wait for reply from him. 

After getting reply if he refuse to entertain your application they will file recovery suit in court and in court you can show that letter as your efforts for clearing the loan.

If the bank manager is resorting to illegal means for recovery of loan amount, you may issue a legal notice to him to refrain from indulging in such illegal activities and to proceed legally following due process of law for recovery.

If he is still not listening or stopping his activities you may either write to his higher office or file an injunction suit restraining him from indulging in such illegal activities other than by due process of law for recovery of loan amount.

  2. Sir, loan will have to be repaid for sure, but yes if you make an application before the civil court of law then you would definitely get the relief of paying in instalments.
  3. Now, you should complain to the police about his demanding bribe and to the bank headquarter also, he will be behind the bars.
