Am 70 years old.
This property is in Chennai. This property is belonged to my f-in-law. He died and their daughters also no more. My wife died on 28.03.2015. I gave regd GPA to third person. The GPA was drafted by his advocate only. and it is registered on 22.06.2015 in Chennai. He sold this property to a builder. He demolished old building and constructed apartments and sold. The GPA holder sold on 23.03.2016 and collected sales proceeds also. I contacted a lawyer in Bangalore, he told me to file a criminal case. I am afraid how long the criminal case, if they start harassing where I will go? If I give you vakalatnama will you get my sales proceeds. And protect me from the GPA holder.

You will have to file a complaint against GPA holder the police for the offence of criminal breach of trust, cheating and fraud u/s 406, 415 and 420 of Indian Penal Code.

Also, a suit for recovery can be filed  in civil Court to recover the sale proceeds from him.

Dear sir,

The GPA only entitle him for what you have authorized him to do(o your behalf). He cant exceed the authority and if he did, he can be charged under the charges of criminal misappropriation and criminal breach of trust and this can be done by filing a police complaint or by filing a complaint to the magistrate. surely, we will be happy to help you and since vakalatnama is an authrization for legal proceedings, you dont need to worry about the legal consequeces. for that, we are equally efficient to control. You can contact me for consultation through kaanoon portal.

hope this solves your query.

Dear sir

There is no need to be afraid of these type of goons. You should hire a renowned Criminal lawyer of local area where that person is residing and then file a police complaint to SP of Huballi and also send a copy to police station. And this complaint should be drafted by your lawyer as he will write all the facts and  potential threats after filing of case so that police can take action and also help in your protection.

You cannot find a relief by giving a vakalatnama to anyone here.

You may have to initiate proper legal action against the power agent by lodging a complaint with the jurisdictional police in order to protect your interests.

Before that you collect the evidence of the money transactions that have been done by the power agent in this regard in order to strengthen your complaint case.
