• Cancelation of sale deed

I excuted a sale deed in 1999 and it was for .017 hectear in .146 hectear . Writer of sale deed write discretion of total property (.146 h) on a page and selling property on next page with boundaries and extent . A word जो वय होता है write on next page to the page of selling property as if the page where selling property is describe removes the total property is seems to be sale and he don so . The sale deed is registered it is a case of material alteration? .l filed a suit for rectification in 2009 when I knew it .Can I take cancelation on account of alteration please help me .

yes you can file a suit for cancellation of the deed.

See you can rectify the mistake by filing the ratification deed cancellation on this ground may not succeed you may ask for ratification to the extent and correction.

You can apply for rectification of sale deed only but cannot apply for cancellation of sale deed merely on basis of a clerical fault.

Since you have filed a suit for rectification in the year 2009, you may better proceed with same without getting deviated.
