• Applied for a post on 85:15 basis, but they didn't award marks in interview

I qualified written marks with 85 % wtge but they disqualified all candidates and didn't award marks in interview, I filed a case in CAT Delhi, the sitting judge says what happened if no marks awarded. All of us disqualified on the same ground technical competence and preparedness. They never fixed any minimum qualifying marks in interview. The ministry says it is their perorgative to fix it. Interview carries only 15% wtge. The judge argues that the government has the freedom to choose more eligible ones. It seems our ground is not entertained by judge namely, changing the selection rules and awarding no marks to any candidate

What should we do?

Tge department cannot arbitrarily fix Marks and set the bar for disqualification.  It has be based upon some reasonable grounds.  File a writ petition in the hc. Kindly elaborate upon the facts and circumstances of the case in order to better appreciate the controversy.

  1. File appeal against order passed by CAT in HC
  2. it does  appear that deliberately no marks have been awarded in interview

First of all read the advertisement due to which you appeared in the written examination, the contents of the advertisement and the judgment of the CAT, whether have the same ingredients or not , if so then challenge the same before the Hon'ble High Court in a Writ, you will get the results because to my mind this is a wrong notion that Governement has power to choose more eligible one.

This notification is an arbitrary abuse of power.

They cannot change the rules of the selection anytime.

You have a good case.

Let me know if the CAT has decided the matter or not?

Dear Client,

It the settled position of law that selection criteria cannot be changed after the admission process is over. “The rules of the game cannot be changed after the game is over. The change of criterion of selection in the midst of selection process is not permissible.

Such prerogatives are rubbished by Courts. Appeal in HC. What was the advertisement ?
