• Is OCTROI in effect now?

I was asked to pay OCTROI tax for relocating goods from Karnataka to Tamil Nadu by a packing and moving agency. Is this tax in effect now? I have a copy of the bill showing the amount charged for this. If this is not applicable, what can I do to sue them? I have also paid GST for the total amount including OCTROI. When I researched about this, I found OCTROI is not applicable in my state. Can you please confirm?

Hello, 

 

The local Municipality in India levies the Octroi charges when the product enters the state. Generally it varies from 3 to 6 % of the Product Value.

Gujrat, Maharashtra and Punjab are the only Indian states where OCTROI is applicable at present.

After the GST the sates have mostly stopped levying taxes in the nature of OCTROI.

Hi 

With introduction of GST, Octroi tax is now subsumed in to GST .

As a result of which your packing services company cannot charge you Octroi. 

Simply visit http://cbec-gst.gov.in, click on CBEC Mitra Helpdesk in the bottom right corner of the page  and then choose "Raise Web Ticket".

On the new window that opens, click on the option to "Report Tax Fraud/Avoidance" and fill in the details required. In the "report" box, make your complaint and don't forget details such as the name and address of the organisation that cheated you.

As of 1 July 2017, with the introduction of GST country-wide, the octroi has been abolished.

From July 2017 after coming of the GST the octroi has been abolished. There can be no such duty and it is illegal to charge you for that.

26 such levies repealed since 2015. Starting July 1, as many as 13 cesses have ceased to exist with the roll out of the Goods and Services Tax (GST). ... As many as 26 cesses levied by the Centre along with excise duty and service tax have been abolished since 2015 to pave way for this indirect tax levy.

With the implementation of the GST from July 2017, the OCTROI has also been abolished through out India.

You may raise a complaint against this fraud in the website meant for it and get a remedial action after which you can even file a complaint before consumer forum for deficiency in service.
