  • Government mandate about address change on Govt. issued ID

I relocated to a new city about a couple of years back. Did not get the new address updated on any of my Govt. IDs. 
My bank has now blocked my account for not furnishing an address proof for the new address. They are not ready to accept anything else (Rental Agreement, Employer issued Letter) except any of the Govt. Issued ID. 
I want to challenge this inflexible behavior of bank for not accepting any other Address Proof (Rental Agreement, Employer issued Letter). 
So, I want to understand if there is a Rule/Law that says that any citizen who has a change of location has to mandatory get the Govt. issued IDs updated with the new address?

The list of documents required to open a savings account are: Identity Proof – Passport/Aadhaar Card/Voter ID/Driving License/PAN Card and Recent Passport Size Photographs. Residence Proof – Aadhaar Card/Driving License/Voter ID/Passport/Utility Bills.

 

2) for change of address in bank account

 Documents for address and identity proof include passport, permanent account number (PAN) card, voter's identity card, valid permanent driving licence, and letter or card issued by Unique Identification Authority of India containing details of name, photograph, address, and Aadhaar number

 

2) you need any of ids mentioned herein above for operating your bank account

The bank shall accept the address which is mentioned in the aadhaar card etc. It will be the address of communication. A temp address can be given where you currently live.

No it is not mandatory as is being stated by the bank.

  • Proof of address - Passport, Driving license, Voter's ID card, electricity and land line bills etc.
  • PAN card.
  • Form 16 (only if PAN card is not available)
  • 2 latest passport size photographs.

Tell them as they are wrong there is no such rule, they are simply troubling you so give them an affidavit duly notorized by the Govt. Notary and if they don't do that then file a case in consumer forum for deficiency in service.

Rent agreement is enough, if bank dose not agree, close the account and open in some other bank. And for permanent address proof, local address is not necessary, You can give your i`d of another city address. What is the problem.

Hello, 

These are internal rule of the bank amounting to administrative actions and as such the same can not be challenged in the court of law. The said rules are not violating any right of your's, just that they are subjecting you to some hardship. 

On the basis of the rent agreement, get the AADHAAR issued and accordingly submit the same to the court.

DBOD.AML.BC. No. 119/14.01.001/2013-14

of RBI for KYC you don't have to give new address proof for change of address is in second point and this is as follows 

2. Reserve Bank has been receiving representations/references from various quarters’ especially migrant workers, transferred employees, etc. regarding problems faced in submitting a proof of current/permanent address while opening a bank account. The matter has since been examined in the light of amendment to the Prevention of Money Laundering Rules (Maintenance of Records), 2005, and accordingly it has been decided to simplify the requirement of submission of ‘proof of address’ as follows:

  1. Henceforth, customers may submit only one documentary proof of address (either current or permanent) while opening a bank account or while undergoing periodic updation. In case the address mentioned as per ‘proof of address’ undergoes a change, fresh proof of address may be submitted to the branch within a period of six months.

  2. In case the proof of address furnished by the customer is not the local address or address where the customer is currently residing, the bank may take a declaration of the local address on which all correspondence will be made by the bank with the customer. No proof is required to be submitted for such address for correspondence/local address. This address may be verified by the bank through ‘positive confirmation’ such as acknowledgment of receipt of (i) letter, cheque books, ATM cards; (ii) telephonic conversation; (iii) visits; etc. In the event of change in this address due to relocation or any other reason, customers may intimate the new address for correspondence to the bank within two weeks of such a change.

This demand made by the bank is their own procedure that they have been instructed to follow, however they cannot be very rigid in this matter, they can accept the rental agreement also as proof of new address, what did the manager say about it, if you want to take it legally you can make a representation to the higher office of the bank narrating the untold miseries you suffered due to bank's reluctant attitude as well as such an unruly behavior and the act of illegally blocking your account.

If there is no response from the higher office also then you may resort to legal action by first sending a legal notice o the bank condemning their act of blocking the account number which is illegal and violation of human rights as well as contrary to the prevailing law in this regard.

After that you can approach consumer forum for relief, remedy and compensation also.
