• Cancellation of country club membership

I had opted for country club membership for Rs.65000, I visited a club once and not satisfied by the service of the club and the environment of the club. When i went through the reviews it same throughout Karnataka and the country. So i called the sales representitive to cancell the membership. But he is denying to cancel.

Kindly help me. The amount was paid thru credit card with installment option .

See in case the service was not as promised then give a legal notice for refund and cancellation of membership in case they deny for same then file a consumer complaint for deficiency of service against the club.

The country club must be having a rule book/manual. Go through it and they must be having a clause for refund. If it is not there send a legal notice and file a complaint against the club in the consumer district protection forum.

Well, it appears you are not satisfied with its ambiance.

There is no grievance against the services which they promised.

So merely because you did not like its location or ambiance is no ground for its cancellation. You should have ade a tour before subscribing its policy.

Now it is too late though you can try your luck by filing a case before the consumer forum.

On the ground of deficiency of services you can cancel the membership and claim refund along with compensation for mental torture. You can get issue a legal notice then file a complaint before the Consumer Forum.

if the company has failed to honour its commitments, under Consumer Protection Act, you can demand refund and compensation and both.
First you would need to issue the notice to the company for refund and if the company fails to refund, then you can move Consumer Protection Act.

Since the service is not satisfactory you may quote the same as the reason for cancellation and sent a legal notice communicating your decision to cancel the membership and demand refund of amount paid and also stop paying anymore installments, let them take any action ion this, your legal notice will protect you from legal onslaughts.

Dear Sir,

Yes. You can get a refund subject to the condition that you made the payment using a credit card.

1) Raise a transaction dispute request with your credit card company ASAP.

2) In the agreement you may have signed there is a clause about membership cancellation and refund during the cool off period (i. e. Within 10 days from the date of registration). Send a cancellation email to Country Club quoting that you do not wish to continue with your membership.

3) Send the same cancellation request in registered mail with acknowledgement also.

4)  If did not get response then get issue a legal notice, and after that go for Consumer Court.
