• Refund issue in Honda showroom

Hi All,

I have paid Rs.Rs.22000 last two months ago for Honda Brv registration and Fancy number to one of sales executive named Suresh Pujari at Green Honda Malakpet Hyderabad. I have got online proofs(gpay,paytm) for payments and but no company provided receipts for above mentioned amount.

He helped us from booking to delivery. Due to sickness he was off work from two months and unable to my registration. I was in connect with him and showroom for a month and Sales manager told me to proceed with registration and fancy number (again I had to pay money).

Now person is absconding and unable to contact via phone from two.weeks. When I reached to Sales manager before a month promised us that he will be recovering my money from exective salary and incentives soon if the executive didn't turn up. 

 After many contacts to showroom, Green honda HR and i tried to locate address of the sales executive and his address was incorrect. Now, HR told that they cannot recover his salary to repay as the salary is less and showroom is afraid of legal issue.

At present, Showroom GM and HR are saying that they can only help with tracing that person. 

Please advise me how to proceed with this issue.

Payment should ha e been made in favour of company or its dealer but not in name of sales executive 

 

2) there is no receipt issued by company 

 

3) if sales executive has absconded you can file case of cheating, criminal breach of trust against him 

 

4) company would not be liable as no payment made to company account

File criminal complaint agasint all, GM, HR and employee, company is responsible for criminal act of employee. You had not paid to employee but company.

If you had paid amount to company paytm account then can take legal action against company. 

Issue a legal notice to green Honda and file a complaint in District consumer forum under defeincy of service and claim refund of money along with interest and compensation for mentally torturing.

Register a case of cheating and breach of trust against the employee and the persons concerned at honda dealership, the dealership to save their name and reputation shall pay the amount. State in complaint the person took money on behalf of Honda and he was representative there and now he is absconding and also there is no correct address with the employer.

Send a legal notice to them 

if they do not refund your money thereafter, you may go ahead and file a case before the consumer forum for fraud and deficiency in services.

Get issue a legal notice to the manager of Honda show room.  And file a complaint against that sales executive in police station.

You do not have to listen to the version of the show room HR or manager in this regard.

Since he was their employee and he was the one collected that amount on behalf of the company and you have the records for having deposited the amount with the company through him,. you may better issue a legal demand notice to the company and give them 7 days time to return the same failing which you may drag them to the consumer forum for deficiency in service and also unfair trade practice mentioning that this act is nothing but a an act of cheating.
