Hi ,. I am a software engineer working for a mnc. I want to raise money for rag pickers in India. Can I directly send my Google pay or paytm qr to collect donation from public. Is it legal. I will also post the qr in all my Facebook Instagram and other social media pages. Is this legal. Can I collect funds as an individual. Finally from the total money collected , I would be taking 2 percent for myself for the time and money I have spent in meeting many rag pickers.

Hello, 

No, you can not do this. It will be better if you open a NGO or a trust and then do the same after taking exemption on tax for the donations from the department.

Hi, You can't collect the money for social purpose on individual basis and if you want to do the same by creating Registered Sangha with help of  other people you can do your work.

SEBI’s consultation paper on crowdfunding released in 2014, recognizes 4 kinds of crowdfunding models: Social lending/Donation crowdfunding, Rewards crowdfunding, Equity Crowdfunding and Peer-to-Peer Lending.

Yours will come under the social lending/ donation crowdfunding.

Since donation crowdfunding works on grants and donations which provide no financial return in any way and thus is exempted from SEBI rules. It is however regulated by the Information Technology Act (2000) and Income Tax regulations.

Non-profit organisations that raise money through crowdfunding platforms are completely exempted from taxation under the current Income Tax regulations. However any individual receiving donations on any platform, unless the company is a non-profit itself, is liable to pay Income Tax.

1.  You as an individual, can collect "accountable" money from only "Indian" public in indian money only.  You will be liable to pay Income Tax on such receipts, after deducting the relevant documentary expenditures etc....

2.  IF you are a unregistered NGO /Society /Trust, without  proper Govt. permissions, THEN you will NOT be able to collect foreign funding.  This will be criminally prosecutable.

2)If the NGO wants Tax rebate for its own fund that is deposited in bank or to provide Tax exemption to the donors then registration from Income Tax department is necessary. To get the Tax exemption certificate under 12 A and 80 G then it must be registered NGO.

 

3) To open a bank account it is compulsory to have a registration of the organisation according to bank laws .The banks need registered oraganisation’s memorandum, registration certificate resolution to open, manage and handle the bank account and transactions of bank account of the organisation.

Social work can be carried out for the underprivileged but that cannot be a source of income for you and if it is..... it is taxable. Although you can show that the 2 percent was spent on you for various things.

See in your account if you collect donation then same can cause issues form a NGo or trust make account of same in bank and paytm bank and then you can carry on with the activity legally.

Dear Sir,

Unless you register your trust or Society you cannot canvas for such donations. After registering an independent entity will come into existence and you are bound to maintain account books of all the donations and get it audited etc.

As an individual you cannot organise such activities because it may be termed as cheating and you be held for committing  a criminal offence.

Instead you may open a charitable trust following the procedures and formalities for the same and go ahead with your intended act of charity.
