• Addition of surname in birth certificate

Hi, In my child birth certificate my surname is missing with my name. What is the procedure to get this surname added with my name(parent).
Please note - I am not looking for any change in child.

The name can be added by effecting a change in name. An affidavit must be made stating your new name and the old one and the reasons for doing so. It has to be printed in the govt  Gazette and should be published in 2 daily newspapers. This way you can do it.

You can make application to the sub registrar of births about the same. He may tell you to execute an affidavit for the same and rectify. If he doesn't do you need to approach the court

Dear Sir,

You can add your surname in your birth certificate in India by moving an application for the same before the authorities where your birth has been registered.

You can get the change of name changing your name ie. adding your surname after the said name as it exists. This will also solve your purpose in respect of your educational certificates in case they don't carry your surname in them.

If this is adopted then I advise you to purchase as many copies of the relevant news papers from the stands when they hit them as thereafter it will be impossible for you to get any such newspaper thereafter. Small expenditure and of extreme value in your life, this act of purchasing will prove.

You are advised to approach the authority where your birth has been registered and move an application for the correction of the same, stating therein that your surname is ………….. And want the same added in your birth certificate.

That this is a mere clerical error. Attach attested photostat copies of your credentials where your surname and your father's surname have been mentioned . Attach photostat copies of the above newspapers is no such certificate is available.

Draft and get attested an affidavit on the above lines and attach it with your application for correction of the same.

You are advised to obtain four or more copies of the corrected birth certificate as you may deem fit as the same will be of great use in your future.

Anyway get the above correction made and apply for the passport. Remember and keep in mind that it is always better to have a surname on your birth certificate and your passport also as the same foes help in life.

The surname in the birth certificate can only be changed by getting an affidavit attested by notary+publishing the change of name in two local news papers+placing the above two along with your application for change in name/rectification in name/addition of surname before the authority who issued your birth certificate.

Move an application in the present matter before the concerned Marriage Registrar, Births. Request him to issue a fresh birth certificate, after adding the surname against the name of your child.

In case the Registrar simply sits over your application and takes no action, approach the High Court against him by way of filing a writ of mandamus.

You should confirm that if the omission of surname was due to your fault or the fault of the authorities concerned, if it is the fault of the latter, then you can give a letter to rectify the mistake which will be done by them immediately.
