• Signed blank paper with sign and thumb impression for home loan

Good morning
I am native Indian currently living in USA for job. During my India visit I purchased apartment and for the home loan I signed a blank paper with thumb impression as asked by LIC home loan agent to complete the Mortgage formalities on last day of my trip.The page was not dated or there wasn't anything written on it other than signature and thumb impression. 

I am scared if that page has used for the loan purposes only and does not get misused. When I checked with LIC agent, I didn't get proper reply!!!

Can you please help me know what precautions can be taken now to avoid any future issues?

You shouldn't have done that 

Call up LIC and give them details of this LIC agent

Asking someone to sign on a blank paper is a misconduct on the part of the agent as such a paper can likely be misused for other things

Alert LIC immediately

Call and also record this through an email

See you can send a letter and email seeking help regarding this issue from the LIC in case they fail to reply In proper manner or give you satisfactory answer you can lodge a police complaint for your safety.

Further you can seek copy of all mortgage and loan related documents from.the bank from same you can check it.

See email LIC and wrote letter seeking first all the loan related documents and mortgage deed.

Secondly informing about the signature on blank pages and asking them from LIC to keep in your possession

If they do not reply properly lodge police complaint.

Further for property transfer registration is required it is not transferred.on signatures.

1. Signing a blank paper is suicidal. The holder of it can fill up the contents to create any liability on the signatory of it.

2. Immediately issue a notice and also write an email to LIC to seek an answer on what is the fate of the stamp paper.

In your email to LIC mention that you had signed on blank paper as requested by agent for completion of mortgage formalities 

 

2) that said agent is not answering your calls 

 

3) that you apprehend that said blank  signed papers can be misused by your agent 

 

4) request LIC to inform you in writing if said agent has used any paper signed by you for purpose other than for loan purposes

2) you have not executed any registered POA fir sale of property 

 

registratuon of POA is mandatory for sale of property

1. I wonder that of you are an literate person then how on earth you agreed to put your thumb impression and that too on a blank paper.

2, Anyway to stop any misuse of this paper immediately send them a detailed e-mail to return you the said blank paper with your thumb impression.

3. Get a copy of the loan agreement as well if you have not got one already.

1. It is a very improper act on your part to sign a blank paper for availing home loan from LIC as advised by the agent since it can be inappropriately misused by the said agent in his favour.

 

2. Write him a letter immediately for returning the said signed blank paper immediately to you within next 15 days.

 

3. If he does nopt retuirn the said paper, send a complaint to the concerned police station alleging that he has managed to take the said signed blank paper from you telling that it will be required by the LIC and after enquiring from LIC you came to know that no such signed blank paper is required by LIC for providing home loan.

 

4. This letter and complaint will shield you to some extent in case the agent misuses the said signed blank paper taken by him from you.

1. You shall have to send the email or mail to the said agent who has taken the said signed blank paper from you under copy to the LIC.

 

2. Your property can not be transferred based on the said blank signed letter of yours but it can create an 'acknowledgement of loan' to be manufactured by the agent.

 

3. Send a police complaintb also which might shield you from any fraudulkent claim  on you to a great extent.

  1. As per the information mentioned in the present query, makes it clear that you had given the blank paper for mortagage purpose, but now you have an apprehension that the same might used for some other other purpose which may trigger you in future.
  2. I would like to advice you that though the paper was a blank paper, but not the stamp paper, it may be used for any other purpose, but surely not for the transfer of property etc.
  3. Still, I would suggest you to please make detailed intimation to the concerned department head of the LIC branch and inform him about the same.
  4. And also als for the return of the blank paper, otherwise you will have to seek legal remedy for the same.

You can inform the concerned LIC office with the details of the agent who collected the duly signed blank papers from you for the purpose of housing loan and instruct the LIC authorities to stop processing loan until you confirm them about this.

Until you dont initiate any action on this, you may face hardships at a later stage

First of all dont send any communication through email, you may not get any proper response.

You send a letter to the LIC office by registered post with a complaint about the LIC agent who has taken your duly signed blank papers and instruct the authorities to stop processing the loan papers  or advise the agent to return the papers he had taken from you.

After that you can plan to initiate legal actions also if necessary.
