• Wrong allegation case against me

How to file a case against a person who has filed wrong case against me. How to file a case against them? It has really impacted my professional and personal life. Yesterday, I have found this letter on internet. Even my advocate asked police that any issue on my name ,and personally I have visited Police but no one said that such case was filed on my name. Yes, it has been dismissed but created a huge impact in my life . Due to all this a police enquiry happed in my office and I have been removed from my project. My family and company Hr was getting continues calls to enquire about me. My friend were getting calls (police took my call history). When my advocate called them that time Police did not say anything. It's really bad that people r using such law to ruin someone life.

Pls note- in this high court order, my first name has been used.

of the Constitution of India, praying to issue a writ in the 
nature of habeas corpus any other appropriate writ/s, 
order/s, directions/s and direct the respondent No.3 to 
secure husband of petitioner from the illegal detention by 
his colleague (person name) and relatives and directed 
the 3rd respondent to initiate legal action whomsoever 
concerned for the illegal detention of petitioner’s husband."

Court order--

not a case of illegal detention.
Hence, in our view, no case is made out for 
interference. The writ petition is accordingly 
dismissed.

approach the civil court and file a suit for recovery of the damages. This is definitely wrong as to what all has happened and you are entitled to get compensation from the person who has filed the case.

You can file a civil.suit  for claiming damages for malicious prosecution against said person claimimg damages and further for defamation in public and office you can also.file a case under 499 ipc for defamation directly with magistrate.

you can file a civil suit for malicious prosecution (only once you are acquitted from the Court) and defamation claiming damages and compensation for the harassment you have been subjected to.
In the alternative, you can also register a case under Section 211 of the Indian Penal Code for the offence of filing false charges against someone with the intent of causing injury or even under Section 500 for criminal defamation.

1.You first need to check whether the order of HC has been challenged in the SC.

2. If it has not been challenged then you can file a criminal case for defamation against this person and also file a suit in the civil court to seek damages from him.

Dear Sir/Madam,

You can take shelter under section 499 and 500 of IPC and file defamation case against them. You can even file a case seeking injunction order against such person/s from interfere with your person and property. The issue does not end if the High Court dismiss the WP. You have many other forums through which you agitate your legal rights. It is true some black sheep misusing the law, if you do not initiate legal action in  different forums then they will continue such activities.

This cannot be said to be a false case.

The petitioner approached high court for a relief, whereas the high court felt that it is not necessary to interfere in this since there appears to be no such commission of the said act.

However if you feel that your name has been spoiled and your reputation in the society has been badly damaged and you suffered lot of hardship and loss, you may file a defamation case against the petitioner who was responsible for this case and repercussions.
