• Pressuring in notice period

I'm a software engineer. After on 1 year experience in particular technology my bass asked me to change the technology.I dont wsnt to do so.Now, I have found a new job and gave a notice period of 2 month to current employer. Now, boss forcing me to complete all pending work just withing 10 days.Which is impossible.They are pressuring me. What should i do?

Dear Client,

Avoid the boss and serve the notice period, Non can do anything except to honor appointment terms. IF there is any clause payment in lieu of notice period, than complain cannot force you to even serve notice period.

Just revert them the actual position that it is impossible to complete the task within 10 days. 

if 2 months notice period is mentioned in Appointment Letter, then you are legally right, don't worry,

See you can serve a legal notice to your current employer  stating that you have already served the notice period and you should be relieved on the date as per same and further you are being harassed to complete work which you are not meant to complete in 10 days and this is harassment . So ask your employer to address the issue and relieve you on the date given with full and final settlement and proper experience letter.

There is no need to do any extra work during your notice period.

 

You can intimate your boss through e-mail that it is not possible to finish the remaining work within 10 days as there is lot of work.

1. Refer to the job contract to find out the terms of quitting as both of you are bounds by its terms and conditions.

2. If you have completed the notice period then you can not be forced to to do any additional work even on the pretext of completion of pending work.

3. So you are free to join the new job now , more so, if you the new employer does not require your release letter from your past employer.

In case you are facing any harassment at your workplace you have to approach to the local police and file a complaint in this regard your employment with your organisation governance on the ground of the appointment letter which is applicable for both the parties

If your boss is torturing you too much. .then just bear with him. .because both of you know that he can't continue doing this for too long. It could also be a possibility that he might be venting out his frustration on you coz you have decided to switch the job but he has to still stay there.

  1. As per the information mentioned in the present query, makes it clear that the act of the employer is arbitrary and against the principle of law.
  2. If the work which now they are demanding is such that cannot be done in ten says or fifteen days then they must not ask this.
  3. You should save everything about this conversation where they have been seeking you to do this impossible task. 
  4. And also write them in detail about the impossibility of the task and if forced then you would be compelled to not to serve he notice period also.
  5. And then if they do not listen to you, leave the company and if not give relieving letter etc. or salary then file a case against the company for attempt to wrongful confinement and civil case if recovery of everything including the salary also.

Since you have already given the notice period to the employer you should now send a written letter to the employer to express your inability to complete the pending tasks in 10 days. The letter should clearly mention how it is impossible to accede to his demand. This letter would create a defence in your favour if employer terminates you.
