• Putting complain before kharij dakhil

We purchased a residential plot from owner ( 4 persons) who have purchased before more than 10 years from someone other (which was ancester property). Now after registration of plot kharij dakhil have been stopped due to complain put by another one. What can we do for the same

See the objection filed on mutation have to be contested before the authority and reply has to be filed along with copy of sale deed and other chain documents. The authority shall consider the objection and your reply and documents on record and pass order accordingly.

1. It is not clear on what basis the objection is put.

2. If your title is clear then such objection would be ignored.

3. The kharij Dhakil is mere mutation of the deed which has no direct nexus with the title of the owner.

4. So visit the office and put your counter against the objection so it is removed and it is recorded in your name.

dakhil kharij is a procedure of recording name of the new buyer of land and cancellation of name of the old owner from the revenue records. this is done at Tehsil of particular area where the land is situated. a form is to be filled and deposited before the Tehsildar. the process takes around 45 days.you can engage a local lawyer for help.

Submit the Sale Deed and also check what objections have been made by the party and do check that all the 4 persons has signed the Sale Deed 

Also contact the previous owner that was there any beneficiary who was not made the party to the deed. 

Else, you will not have any problem as they have consented in selling off their property. 

You can also change your advocate if any as he might have interest for extra money.

The property was an ancestral property. The complainant must be one of the person who either was a shareholder and has filed a complaint with a malicious intention or he was a shareholder who was denied a share and was not a party to the proceeds which came from the sale of the land. Therefore find the status of the complainant and proceed accordingly.

1. Have you obtained a copy of complaint? If no then obtain a copy of complaint and file your reply to it.

2. Depending on your reply the complaint will be decided one way or other. If complaint is upheld then you will have to challenge the order of tehsildar in the higher courts.
